| RECOMMENDATIONS TO THE MINISTER - IMMIGRATION AND REFUGEE BOARD APPOINTMENTS | RECOMMANDATIONS AU MINISTRE - NOMINATIONS À LA COMMISSION DE L'IMMIGRATION ET DU STATUT DE RÉFUGIÉ |
WHEREAS the Minister of Citizenship and Immigration has stated her intention to merge the current Advisory Panel and the Chairperson’s Selection Board of the Immigration and Refugee Board of Canada (IRB), and to be given discretionary power to appoint half of the six external members of the proposed committee structure, as per recommendation five contained the recent Public Appointments Commission Secretariat report; |
CONSIDÉRANT QUE la ministre de la Citoyenneté et de l’Immigration a déclaré son intention de regrouper le Conseil consultatif actuel et le Jury de sélection du président de la Commission de l’immigration et du statut de refugié du Canada, et d’avoir le pouvoir discrétionnaire de nommer la moitié des six membres extérieurs de ce conseil restructuré conformément à la 5e recommandation du rapport publié récemment par le Secrétariat de la Commission des nominations publiques; |
| AND WHEREAS these changes will politicize the merit-based, non-partisan, and independent nature of the current IRB appointment process; | CONSIDÉRANT QUE ces changements vont politiser le système actuel de sélection, non partisan et de nature indépendante, de la Commission de l’immigration et du statut de refugié du Canada; |
| AND WHEREAS the government, having created a crisis by its failure to appoint a sufficient number of IRB adjudicators, has created a growing backlog of refugee claimants, leaving many to live in limbo; | CONSIDÉRANT QUE la crise créée par le gouvernement en raison de son incapacité à nommer un nombre suffisant de juges-arbitres à la Commission, a créé des retards importants dans l’étude des demandes de statut de réfugié, retards qui laissent de nombreux demandeurs vivre dans l'incertitude; |
| AND WHEREAS longer delays also have a significant impact on security, family reunification, and social costs associated with education, health, and social assistance; | ENFIN, CONSIDÉRANT QUE de longs délais ont également un impact important sur la sécurité, la réunification des familles et les coûts sociaux associés à l’éducation, aux soins de santé et à l’aide sociale; |
| BE IT RESOLVED that the Standing Committee on Citizenship and Immigration call upon the Minister to reject recommendation five contained in the recent Public Appointments Commission Secretariat report, and to immediately fill the remaining board vacancies within the Immigration and Refugee Board of Canada in order to reduce the growing backlog of individuals awaiting case review hearings; and to immediately fill remaining Board vacancies by reappointments from the pool of available and qualified applicants; | PAR CONSÉQUENT, le Comité permanent de la citoyenneté et de l'immigration demande au ministre de rejeter la 5e recommandation du rapport publié récemment par le Secrétariat de la Commission des nominations publiques et de pourvoir immédiatement les postes vacants au sein de la Commission de l'immigration et du statut de réfugié afin de réduire les retards dans l’étude des demandes de révision et d’audience relatives au statut de réfugié; et de pourvoir immédiatement les postes vacants à la Commission en renouvelant des nominations à l’aide du répertoire de candidats disponibles et qualifiés; |
| BE IT FURTHER RESOLVED that the Standing Committee on Citizenship and Immigration request that the Chair issue a press release on behalf of the Committee to outline the Committee’s concern on this issue. | PAR CONSÉQUENT ÉGALEMENT, le Comité permanent de la citoyenneté et de l’immigration demande au président de publier au nom du Comité un communiqué de presse afin d’exposer les préoccupations du Comité dans ce dossier. |

| The issues raised in this report by way of motion follows committee hearings touching upon them and in the midst of the committee finalizing a report relating to these same issues. The committee report is at the concluding stage where it too will be reported to the House of Commons but with a summary of evidence introduced and commentaries of various witness so as to place the reports findings and recommendations in context. There is little purpose to the filing of a report in the form of a motion in advance of the report proper, except perhaps for purposes unrelated to the issues at hand. | Les questions soulevées dans ce rapport par voie de motion font suite à des audiences où elles ont été abordées et nous sont soumises au moment où le Comité achève la rédaction d’un rapport sur ce même sujet. Le rapport du Comité, qui en est à l’étape finale de rédaction, sera lui aussi présenté à la Chambre des communes, mais il sera accompagné d’un résumé des témoignages et des observations de divers témoins de manière à situer les constatations et recommandations du comité dans leur contexte. Il n’est pas utile de déposer un rapport sous forme de motion avant le rapport lui-même, sauf peut-être pour des raisons indépendantes des questions qu’il touche. |

| WHEREAS the Public Appointments Commission Secretariat report prepared by Peter Harrison, a widely respected, non-partisan civil servant, made nine recommendations to make the process more open and accountable; | ATTENDU QUE le rapport du Secrétariat de la Commission des nominations publiques préparé par Peter Harrison, un fonctionnaire impartial et très respecté, a formulé neuf recommandations visant à rendre le processus plus ouvert et responsable; |
| AND WHEREAS the report recommended a balanced approach to streamline the board in which both the Chair and Minister appoint new members, enabling the process to move more quickly so vacancies on the Board can be filled faster; | ATTENDU QUE le rapport recommandait une approche équilibrée pour rationaliser le conseil où tant le président que le ministre nomment de nouveaux membres, accélérant ainsi le processus de nomination pour pourvoir les postes vacants du conseil plus rapidement; |
| BE IT RESOLVED that we support all nine recommendations from the report by the Public Appointments Commission Secretariat to ensure the creation of a merit-based appointments system that will be more efficient, more effective, more transparent and more accountable. | IL EST RÉSOLU QUE nous appuyions les neuf recommandations du rapport du Secrétariat de la Commission des nominations publiques afin d’assurer la création d’un système de nomination fondé sur le mérite, qui sera plus efficient, plus efficace, plus transparent et plus responsable. |
