AGREEMENT

Between

THE TLICHO FIRST NATION,
Represented by the Dogrib Treaty 11 Council

(“TLICHO FIRST NATION”)

And

YELLOWKNIVES DENE FIRST NATION (DETTAH),
YELLOWKNIVES DENE FIRST NATION (NDILO)
LUTSEL K’E FIRST NATION AND DENINU KUE FIRST NATION,
Represented by NWT TREATY 8 TRIBAL CORPORATION

(“AKAITCHO TERRITORY DENE FIRST NATIONS”)

(“THE PARTIES”)


WHEREAS

Tlicho First Nation are completing the negotiation of a Land Claims and Self-government Agreement with the Governments of Canada and the Northwest Territories (“Tlicho Agreement”);

Akaitcho Territory Dene First Nations are engaged in the negotiation of an agreement with the Governments of Canada and the Northwest Territories, pursuant to the Framework Agreement of July 25, 2000 (“Akaitcho Agreement”);

Tlicho First Nation and Akaitcho Territory Dene First Nations have overlapping interests in lands and resources; and

The Parties wish to resolve issues about their overlapping interests in a spirit of traditional respect and co-operation, and to their mutual benefit;


THEREFORE THE PARTIES HEREBY AGREE AS FOLLOWS:
  1. Tlicho First Nation will continue to exercise harvesting rights east of the Tlicho Primary Use Area that is bounded on the east by the solid red line on the attached map.

  2. Akaitcho Territory Dene First Nations will continue to exercise harvesting rights west of the Akaitcho Territory Dene First Nations’ Primary Use Area that is bounded on the west by the blue line on the attached map.

  3. The Parties’ Shared Primary Use Area is the area that is marked in light green diagonal lines on the attached map (“Shared Primary Use Area”), which is the portion of the Tlicho Primary Use Area that is also within the Akaitcho Territory Dene First Nations’ Primary Use Area.

  4. In the Tlicho Agreement, the eastern boundary of Wek’eezhii shall be the red line on the attached map.

  5. Akaitcho Territory Dene First Nations and Tlicho First Nation shall enter into an interim agreement to govern their shared decision making within the Shared Primary Use Area that will apply until the Akaitcho Agreement takes effect and the Tlicho Agreement is amended.

  6. Prior to the Akaitcho Agreement taking effect, the Parties shall negotiate the provisions of a permanent Shared Primary Use Area Agreement that will provide Akaitcho Territory Dene First Nations and the Tlicho First Nation with equal rights to participate in any decision making boards with jurisdiction respecting lands and resources within the Shared Primary Use Area.

  7. Tlicho First Nation will ensure that the Tlicho Agreement is consistent with this Agreement.

  8. Akaitcho Territory Dene First Nations will ensure that the Akaitcho Agreement is consistent with this agreement.

  9. Each of the Parties agree to consult the other with respect to any management or regulatory decisions respecting lands and resources that will affect the interests of the other Party, whether or not such decisions have effect within the Primary Use Area of that Party.

  10. In exercising their authorities with respect to the management or regulation of lands or resources, the Parties shall
    1. Work co-operatively to protect their respective and mutual interests;

    2. Foster sustainable development and the protection of lands, resources and harvesting opportunities for present and future generations;

    3. Take steps to acquire and use traditional knowledge as well as other types of scientific knowledge and expert opinion.
  11. This agreement is subject to legal and technical review by the parties.
