The Standing Committee on Government Operations and Estimates met at 9:31 a.m. this day, in Room 362, East Block, the Chair, Reg Alcock, presiding.

Members of the Committee present: Reg Alcock, Roy Cullen, Raymonde Folco, Paul Forseth, Judy Sgro, Paul Szabo, Tony Tirabassi and Tony Valeri.

Other Member present:  John Bryden

It was agreed, -- That the Public Service Alliance of Canada be invited to present its comments on Bill C-25 in a letter to the clerk for distribution to Committee members.

Pursuant to its Order of Reference of Thursday, February 20, 2003, the Committee resumed consideration of Bill C-25, An Act to modernize employment and labour relations in the public service and to amend the Financial Administration Act and the Canadian Centre for Management Development Act and to make consequential amendments to other Acts (See Minutes of Proceedings, Thursday, February 27, 2003, Meeting No. 12).

The Committee resumed consideration of Clause 2.

Pauline Picard moved, -- That Bill C-25, in Clause 2, be amended by deleting lines 9 to 18 on page 29.

After debate, the question was put on the amendment, it was negatived on the following recorded division:

Pauline Picard moved, -- That Bill C-25, in Clause 2, be amended by deleting lines 38 to 46 on page 29 and lines 1 to 3 on page 30.

After debate, by unanimous consent, the motion was withdrawn.

Pauline Picard moved, -- That Bill C-25, in Clause 2, be amended by replacing line 16 on page 37 with the following:

“changed in accordance with section 104 and the bargaining agent advises the Board of the process chosen for the resolution of disputes, only in cases where an agreement cannot be reached, so as to prevent mandatory decision-making before negotiation.”

Tony Tirabassi moved, -- That Bill C-25, in Clause 2, be amended by replacing line 13 on page 38 with the following:

“award is in force, within the four months”

Pauline Picard moved, -- That Bill C-25, in Clause 2, be amended by replacing line 38 on page 39 with the following:

“public administration, or in a particular service or only a portion thereof, where all the parties to the collective bargaining in the federal public service have reached an agreement with respect to a reasonable process.”

Pauline Picard moved, -- That Bill C-25, in Clause 2, be amended by adding after line 10 on page 40 the following:

“110.1 The employer, the bargaining agent for a bargaining unit and the deputy head for a particular department named in Schedule I to the Financial Administration Act or for another portion of the federal public administration named in Schedule IV to that Act must jointly determine a process for the joint management of the pension system.”
