MINUTES OF PROCEEDINGS

Meeting No. 6

Tuesday, November 26, 2002

The Standing Committee on Aboriginal Affairs, Northern Development and Natural Resources met at 3:30 p.m. this day, in Room 237-C, Centre Block, the Chair, Raymond Bonin, presiding.

Members of the Committee present: Gérard Binet, Raymond Bonin, Serge Cardin, David Chatters, John Finlay, Nancy Karetak-Lindell and Benoît Serré.

Acting Members present: Gerald Keddy for Inky Mark, Ivan Grose for Brent St-Denis, Raymond Simard for John Godfrey, Joe Comartin for Pat Martin, Raymond Simard for Anita Neville and Clifford Lincoln for John Godfrey.

In attendance: From the Library of Parliament: Jean-Luc Bourdages, Analysts.

Witnesses: From the Department of Natural Resources: Joanne Kellerman, General Counsel, Legal Services; David McLellan, Acting Director General, Energy Resources Branch.

Pursuant to its Order of Reference of Tuesday, October 29, 2002, the Committee resumed consideration of Bill C-4, An Act to amend the Nuclear Safety and Control Act (See Minutes of Proceedings, Tuesday, November 19, 2002, Meeting No. 3).

The Committee proceeded to the Clause-by-Clause consideration of the Bill.

On Clause 1,

Joe Comartin moved, -- That Bill C-4, in Clause 1, be amended by replacing line 9 on page 1 with the following:

“Commission shall, in addition to filing a notice”

The question being put on the amendment, it was negatived by a show of hands:

YEAS:  3

NAYS:  6

Joe Comartin moved, -- That Bill C-4, in Clause 1, be amended by adding after line 14 on page 1 the following:

“(3.1) The owner or occupant of, or any other person who has a right to or interest in, the affected land or place, must be insured for a minimum of 10 billion dollars to cover the costs of decommissioning and decontamination.”

The Chair ruled the proposed motion out of order on the grounds that it was beyond the scope of the Bill.

Following debate, it was agreed by recorded division,-- That the decision of the Chair be sustained.

YEAS: Gerard Binet, John Finlay, Clifford Lincoln, Nancy Karetak-Lindell, Raymond Simard, Benoît Serré, Ivan Grose, David Chatters, Gerald Keddy -- (9)

NAYS: Serge Cardin, Joe Comartin -- (2)

Clause 1 carried by recorded decision.

The Title carried.

The Bill carried.

ORDERED, -- That the Chair be instructed to report Bill C-4, The Nuclear Safety and Control Act, without amendment, as the First Report of the Committee, to the House of Commons at the earliest opportunity.

At 5:31 p.m., the Committee adjourned to the call of the Chair.
