Tuesday, November 27, 2001
The Standing Committee on Environment and Sustainable Development met in a televised session at 9:10 a.m. this day, in Room 253-D, Centre Block, the Chair, Charles L. Caccia, presiding.
Members of the Committee present: Roy Bailey, Bernard Bigras, Charles L. Caccia, Joe Comartin, John Herron, Gar Knutson, Karen Kraft Sloan, Rick Laliberte, Bob Mills, Karen Redman, Julian Reed, Andy Savoy, Hélène Scherrer, Alan Tonks.

Pursuant to its Order of Reference of Tuesday, March 20, 2001, the Committee resumed consideration of Bill C-5, An Act respecting the protection of wildlife species at risk in Canada (See Minutes of Proceedings, Thursday, March 22, 2001, Meeting No. 6).
The Committee resumed Clause-by-Clause consideration of the Bill.
The witnesses answered questions.
On Clause 130,
Karen Redman moved, -- That Bill C-5, in Clause 130, be amended
(a) by replacing lines 14 to 16 on page 63 with the following:
“130. (1) COSEWIC must assess the status of each wildlife species set
out in Schedule 2 or 3, and, as part of the assessment, identify”
(b) by replacing lines 27 to 38 on page 63 with the following:
“(2) In the case of a species set out in Schedule 2, the assessment must be
completed within 30 days after section 14 comes into force.
(3) If an assessment of a wildlife species set out in Schedule 2 is not
completed within the required time or, if there has been an extension, within
the extended time, COSEWIC is deemed to have classified the species as
indicated in Schedule 2.
(4) In the case of a species set out in Schedule 3, the assessment must be
completed”
(c) by replacing line 6 on page 64 with the following:
“Schedule 2 or 3. The Minister must include a”
After debate, the question being put on the amendment, it was adopted.
The Chair ruled that the previous vote shall apply to the following amendments:
-- That Bill C-5, in Clause 2, be amended by replacing line 35 on page 5 with the following:
“Risk set out in Schedule 1.”
-- That Bill C-5, in Clause 42, be amended by
(a) replacing line 8 on page 22 with the following:
"42. (1) Subject to subsection (2), the competent minister must
include a"
(b) adding after line 15 on page 22 the following:
"(2) With respect to wildlife species that are set out in Schedule 1 on
the day section 27 comes into force, the competent minister must include a
proposed recovery strategy in the public registry within three years after that
day, in the case of a wildlife species listed as an endangered species, and
within four years after that day, in the case of a wildlife species listed as a
threatened species."
-- That Bill C-5, in Clause 65, be amended by
(a) replacing line 1 on page 31 with the following:
“65. (1) Subject to subsection (2), within three years after a wildlife”
(b) adding after line 9 on page 31 the following:
“(2) With respect to wildlife species that are set out in Schedule 1 as a
species of special concern on the day section 27 comes into force, the
competent minister must include a management plan in the public registry within
five years after that day.”
That Bill C-5 be amended by replacing Schedules 1, 2 and 2.1 on pages 68 to 86 with the following:

eliminate disincentives for actions taken by persons to protect species at
risk;
(b) a strategy for public education;
(c) the establishment of mechanisms for sharing information both within
and among various levels of governments and between the federal government and
other persons;
(d) the creation of awards and recognition programs;
(e) methods of collecting and sharing knowledge about species at risk,
including local and traditional knowledge;
(f) the provision of information respecting methods to formalize
commitments to land stewardship including land conservation easements,
agreements or government programs;
(g) a commitment to provide technical and scientific support to persons
engaged in stewardship activities; and
(h) a strategy for implementing the consultation provisions under this
Act, including the provisions of subsections 48(3) and 66(3)."
