MINUTES OF PROCEEDINGS

Meeting No. 56

Tuesday, May 9, 2000

The Standing Committee on Transport met at 3:32 p.m. this day, in Room 705, La Promenade Building, the Chair, Stan Keyes, presiding.

Members of the Committee present: Gérard Asselin, Roy Bailey, Murray Calder, Bill Casey, Stan Dromisky, Claude Drouin, Joe Fontana, Charles Hubbard, Ovid Jackson, Stan Keyes, Val Meredith, Lou Sekora.

In attendance: From Legislative Services: Jacques Lahaie, Legislative Clerk. From the Library of Parliament: John Christopher and June Dewetering, Researchers.

Witnesses: From the Transport Canada: Valérie Dufour, Director General, Air Policy and Programs; Jacques E. Pigeon, General Counsel, Legal Services.

Pursuant to its Order of Reference of Tuesday, February 29, 2000, the Committee resumed consideration of Bill C-26, An Act to amend the Canada Transportation Act, the Competition Act, the Competition Tribunal Act and the Air Canada Public Participation Act and to amend another Act in consequence (See Minutes of Proceedings, Tuesday, April 4, 2000 , Meeting No. 42).

The Committee resumed Clause-by-Clause consideration of the Bill.

By unanimous consent, the Committee agreed to revert to New Clause 7.1.

It was agreed, -- That the amendment be further amended in sub-paragraph (3) after the word "subsection (2)" by adding the words "for which no other remedy exists".

By unanimous consent, the Committee reverted to Clause 13, which has been stood.

On Clause 13,

Joe Fontana moved, -- That Bill C-26, in Clause 13, be amended by

(a) replacing lines 36 to 42 on page 16 with the following:

"paragraph (h) and by adding the following after paragraph (i):

(j) acts or conduct of a person operating a domestic service, as defined in subsection 55(1) of the Canada Transportation Act, that are specified under paragraph (2)(a); and

(k) the denial by a person operating a "domestic service", as defined in subsection 55(1) of the Canada Transportation Act, of access on reasonable commercial terms to facilities or services that are essential to the operation in a market of an "air service", as defined in that subsection, or refusal by such a person to supply such facilities or services on such terms.

(b) replacing lines 5 to 7 on page 17 with the following:

"Minister of Transport, make regulations

(a) specifying acts or conduct for the purpose of paragraph (1)(j); and

(b) specifying facilities or services that are essential to the operation of an air service for the purpose of paragraph (1)(k)."

After debate, the question being put on the amendment, it was agreed to on division.

After debate, Clause 13, as amended, carried on division.

The Title carried.

The Bill, as amended, carried.

ORDERED, -- That the Chair report Bill C-26 with amendments to the House as the Second Report of the Committee.

ORDERED, -- That Bill C-26, An Act to amend the Canada Transportation Act, the Competition Act, the Competition Tribunal Act and the Air Canada Public Participation Act and to amend another Act in consequence, as amended, be reprinted for the use of the House of Commons at Report Stage.

It was agreed, -- That a letter be sent to the Minister accompanying the Report requesting the information on airline pricing and capacity for the Committee to review in six months' time.

At 3:57 p.m., the Committee adjourned to the call of the Chair.
