Meeting No. 22

Wednesday, April 12, 2000

The Standing Committee on Citizenship and Immigration met at 3:35 p.m. this day, in Room 209, West Block, the Chair, Joe Fontana, presiding.

Members of the Committee present: Rob Anders, Jean Augustine, Leon Benoit, Bernard Bigras, John Bryden, Joe Fontana, Sophia Leung, Rick Limoges, Steve Mahoney, Pat Martin, John McKay, David Price and Andrew Telegdi.

Acting Member present: Lynn Myers for Paul Bonwick.

In attendance: From the Parliamentary Research Branch of the Library of Parliament: Margaret Young, Research Officer.

Witnesses: From theDepartment of Citizenship and Immigration: Rosaline Frith, Director General, Integration; Norman Sabourin, Registrar for Citizenship; Theresa Harvey, Deputy Director, Social Policy and Programs, Selection Branch; Eric Stevens, Counsel, Legal Services; Max Wolpert, Counsel and Acting Deputy Director, Crimes Against Humanity and War Crimes Section.

Pursuant to its Order of Reference of Thursday, March 23, 2000, the Committee resumed consideration of Bill C-16, An Act respecting Canadian citizenship (See Minutes of Proceedings, Wednesday, March 29, 2000 , Meeting No. 19).

The Committee resumed consideration of Clause 2.

After debate, Clause 2, was allowed to stand.

On Clause 3

On motion of Andrew Telegdi, it was agreed, - That Bill C-16, in Clause 3, be amended by replacing, in the French version, line 30 on page 2 with the following:

" la présente loi. "

And the question being put on Clause 3, as amended, it was carried.

On Clause 4

Andrew Telegdi moved, - That Bill C-16, in Clause 4, be amended by replacing line 29 on page 2 with the following:

"if, after the coming into force of this section,"

After debate, the question being put on the amendment, it was agreed to on division.

And the question being put on Clause 4, as amended, it was carried.

Clause 5 carried on division.

On Clause 6

Pat Martin moved, - That Bill C-16, in Clause 6, be amended by replacing lines 4 to 6 on page 4 with the following:

"be a permanent resident and has resided in Canada for at least"

After debate, the question being put on the amendment, it was negatived on division.

And the question being put on Clause 6, it was carried on division.

Clause 7 carried.

On Clause 8

After debate, the question being put on Clause 8, it was carried on the following recorded division:

On motion of Andrew Telegdi, is was agreed, - That Bill C-16, in Clause 11, be amended by replacing lines 1 and 2 on page 6 with the following:

"(e) has always been stateless; and"

Clause 11, as amended, carried.

Clauses 12, 13, 14 and 15 carried.

On Clause 16

Pat Martin moved, -- That Bill C-16, in Clause 16, be amended by replacing, in the English version, line 19 on page 7 with the following:

"by knowingly concealing material circumstances if the"

After debate, the question being put on the amendment, it was agreed to.

And the question being put on Clause 16, as amended, it was carried on division.

On Clause 17

Pat Martin moved, -- That Bill C-16, in Clause 17, be amended by replacing line 38 on page 7 with the following:

"Court -- Trial Division or the Federal Court of Appeal or the Supreme Court of Canada in the event of an appeal finally determines, on a"

After debate, it was agreed that the amendment be allowed to stand.

And it was agreed, - That Clause 17 be allowed to stand.

Clause 18 carried on division.

Clauses 19 and 20 carried.

Clauses 21 and 22 carried on division.

On Clause 23

After debate, the question being put on Clause 23, it was carried on division.

Clause 24 carried on division.

Clauses 25 and 26 carried.

Clause 27 carried on division.

Clauses 28 to 30 inclusive carried on division.

On Clause 31

Leon Benoit moved, - That Bill C-16, in Clause 31, be amended by replacing lines 22 to 25 on page 15 with the following:

"Appointment

31.(1) Subject to subsection (1.1), the Governor in Council may appoint a person as a Citizenship Commissioner, following an open competition under the Public Service Employment Act, to hold office, during pleasure, for a term of not more than five years, and the person may be removed for cause by the Governor in Council.

Removal in the first year

(1.1) A Citizenship Commissioner may be removed by the Governor in Council without cause during the year after appointment."
