The Standing Committee on Justice and Human Rights met at 7:02 o’clock p.m. this day, in Room 536, Wellington Building, the Chair, Shaughnessy Cohen, presiding.

Members of the Committee present: Michel Bellehumeur, Shaughnessy Cohen, Paul E. Forseth, Derek Lee, Peter G. MacKay Gurbax Malhi, John Maloney, Richard Marceau and Jack Ramsay.

Acting Members present: Carmen Provenzano for Eleni Bakopanos, Guy St-Julien for Paul DeVillers, Sarmine Bulte for Nick Discepola, Claude Drouin for Sheila Finestone, Chuck Cadman for Garry Breitkreuz and Elinor Caplan for Andrew Telegdi.

In attendance: From the Research Branch of the Library of Parliament: Philip Rosen, Senior Analyst and Marilyn Pilon, Research Officer. From the Committees and Legislative Services Branch : Charles Bellemare, Legislative Clerk.

Witnesses : From the Department of Justice: Yvan Roy, senior general counsel; Gillian Blachell, lawyer.

Pursuant to its order of reference dated October 31, 1997, the Committee resumed the study of Bill C-16, An Act to amend the Criminal Code and the Interpretation Act (powers to arrest and enter dwellings) (See Minutes of Proceedings, Tuesday, November 4, 1997, Meeting No. 2).
It was agreed that Sandra Teves’ paper on Bill C-16 be filed as an exhibit with the Clerk of the Committee (Exhibit "A").

The Committee commenced clause-by-clause consideration of the Bill.

On Clause 1

Derek Lee moved,--That Clause 1, be amended by replacing line 5 on page 3 with the following:

"enter a dwelling-house under section 529 or an authorization under section 529.4 or at"

The question being put on the amendment, it was agreed to.

Clause 1, as amended, carried.

Clauses 2 to 4 inclusive carried.

The Preamble carried.

The Title carried.

The Bill, as amended, carried.

ORDERED: That the Chair report the Bill, with amendments, to the House as First Report of the Committee.

At 7:35 o’clock p.m., the Committee adjourned to the call of the Chair.
