Meeting No. 147

Tuesday, June 1st, 1999

The Standing Committee on Justice and Human Rights met at 9:15 a.m. this day, in Room 308, West Block, the Chair, John Maloney, presiding.

Member(s) of the Committee present: Jim Abbott, Reg Alcock, Chuck Cadman, Aileen Carroll, Paul DeVillers, Ivan Grose, Derek Lee, Peter MacKay, John Maloney, John McKay, John Reynolds and Jacques Saada.

Acting Member present: Lynn Myers for Eleni Bakopanos.

In attendance: From the Library of Parliament: Luc Gagné, Marilyn Pilon, Researchers and Philip Rosen, Senior Analyst.

Witness(es): From the Department of Justice: Catherine Kane, Counsel, Criminal Law Policy Section.

Pursuant to Standing Order 108(2), the Committee resumed consideration of Proposals for a Miscellaneous Statute Law Amendment Act, 1998. (See Minutes of Proceedings dated May 26, 1999, Meeting No. 145)

It was agreed, -- That the Proposals for a Miscellaneous Statute Law Amendment Act, 1998, as amended, be adopted.

It was agreed, -- That the Chair be authorized to report the Proposals for a Miscellaneous Statute Law Amendment Act, 1998 to the House.

Notice having been given, Jim Abbott moved, -- That the Standing Committee on Justice devote one hour to inquire from Commissioner Murray - RCMP - into the reasons for the termination of the RCMP investigation into allegations of fraud in BRE-X Minerals investigation.

John McKay moved, -- That the motion be amended by deleting the words "That the Standing Committee on Justice devote one hour to inquire from Commissioner Murray - RCMP - into" and replace it with the following: "That the Committee write to Commissioner Murray of the RCMP to ask for", and that the Commissioner's response be received no later than 10:00 a.m. on Tuesday, June 8, 1999.

After debate, the question being put on the amendment, it was carried by a show of hands -- YEAS: 7 NAYS: 5

By unanimous consent, Jim Abbott moved, -- That the main motion be withdrawn.

After debate, the question being put on the motion, it was agreed to.

Pursuant to Standing Order 108(2), the Committee commenced consideration of the Mental Disorder Provisions of the Criminal Code.

At 9:55 a.m., Catherine Kane from the Department of Justice made an opening statement and answered questions.

By unanimous consent, the Committee proceeded to discuss its future business.

At 10:40 a.m., the Committee adjourned to the call of the Chair.
