Wednesday, February 17, 1999

The Standing Committee on Justice and Human Rights met at 3:40 p.m. this day, in Room 371, West Block, the Chair, John Maloney, presiding.

Member(s) of the Committee present: Reg Alcock, Eleni Bakopanos, Chuck Cadman, Paul DeVillers, Peter MacKay, John Maloney, John Reynolds and Jacques Saada.

Acting Member(s) present: Bryon Wilfert for Aileen Carroll, Larry McCormick for Ivan Grose, Richard Harris for Jim Abbott, Pierre Brien for Michel Bellehumeur.

In attendance: From the Library of Parliament: Marilyn Pilon, Researcher; Philip Rosen, Senior Analyst.

Witness(es):From the Ontario Ministry of Transportation: Frank D'Onofrio, Director, Road Safety User Project; Donna Connelly-Millar, Senior Policy Advisor.

Pursuant to Standing Order 68(4)(a) and the Order of Reference dated Thursday, October 30, 1997, the Standing Committee on Justice and Human Rights resumed consideration of the Criminal Code impaired driving provisions. (See Minutes of Proceedings dated Wednesday, February 3, 1999, Meeting No. 109)

Frank D'Onofrio made an opening statement, and along with Donna Connelly-Millar answered questions.

At 4:50 p.m., the sitting was suspended.

At 5:00 p.m., the sitting resumed.

John Reynolds moved, -- That in view of the fact that the Justice Shaw decision in B.C. has caused the dismissal of charges under Section 163.1(4) of the Criminal Code (child pornography) against a second individual in B.C., and in view of the fact that some 38 charges are pending under this same section of the Criminal Code, which could also be in jeopardy due to the Shaw decision, that this Committee take immediate action to reinstate Section 163.1(4) in it's applicability in B.C., notwithstanding the pending B.C. Court of Appeal hearing on the Shaw decision.

After debate, the question being put, the motion was defeated on the following recorded division:
