MINUTES OF PROCEEDING
(Meeting No. 16)

THURSDAY, DECEMBER 4, 1997

The Standing Committee on Industry met at 3:39 o’clock p.m., this day, in room 705, La Promenade Building, the Chair, Susan Whelan, presiding.

Members of the Committee present: Eugène Bellemare, Marlene Jennings, Francine Lalonde, Walt Lastewka, Eric Lowther, Ian Murray, Jim Pankiw, Janko Peric, Alex Shepherd and Susan Whelan.

Acting Members present: John Maloney for Bonnie Brown; and Gary Pillitteri for Tony Ianno.

In attendance: From the Research Branch of the Library of Parliament: Antony Jackson, Research Officer.

Witnesses: From the Department of Industry: Allan MacGillivray, Director, Industry Framework, Telecommunications Policy Branch; Larry Shaw, Director, Industry Framework, Telecommunications Policy Branch; Millie Nickason, Counsel, Legal Services; and Thierry Husson, Senior Advisor, Spectrum, Information Technologies and Telecommunications.

Pursuant to an Order of Reference of the House dated Tuesday, November 25, 1997, the Committee resumed consideration of Bill C-17, An Act to amend the Telecommunications Act and the Teleglobe Canada Reorganization and Divestiture Act.

On Clause 1

The witnesses answered questions.

Eric Lowther proposed to move, - That Clause 1, be amended by replacing line 5 on page 1 with the following:

"Canadian carrier" means a telecommunications common carrier that is subject to the legislative authority of Parliament, and includes a partnership of Canadian carriers;

RULING BY THE CHAIR

The Chair ruled the proposed amendment out of order because it was a substantive amendment to the interpretation clause.

Clause 2 carried.

On Clause 3

By unanimous consent, Walt Lastewka moved the following amendments concurrently:

That Clause 3, be amended by replacing lines 3 and 4 on page 2 with the following:

"Commission shall provide international telecommunications services except in accordance with an international"

That Clause 3, be amended by replacing lines 7 and 8 on page 2 with the following:

"er shall, except in accordance with an international telecommunications service licence, provide international telecom-"

That Clause 3, be amended by replacing line 13 on page 2 with the following:

After debate, the question being put on the motions, they were agreed to, on division.

Clause 3, as amended, was carried, on division.

After debate, Clause 4 carried.

Clause 5 carried.

On Clause 6

Walt Lastewka moved, - That Clause 6, be amended by replacing lines 28 to 42 on page 3 and lines 1 and 2 on page 4 with the following:

"46.1 The Commission may

(a) if it determines that to do so would facilitate the interoperation of Canadian telecommunications networks, administer:

(i) databases or information, administrative or operational systems related to the functioning of telecommunications networks, or

(ii) numbering resources used in the functioning of telecommunications networks, including the portion of the North American Numbering Plan resources that relates to Canadian telecommunications networks; and

(b) determine any matter and make any order with respect to the databases, information, administrative or operational systems or numbering resources."

After debate and the question being put on the motion, it was agreed to.

On motion of Walt Lastewka, it was agreed, - That Clause 6, be amended by deleting lines 17 to 19 on page 4.

Walt Lastewka moved, - That Clause 6, be amended by replacing lines 29 to 37 on page 4 with the following:

"46.5 The Commission may regulate

(a) the manner in which any person provides services relating to any of the matters referred to in paragraph 46.1(a); and

(b) the rates, whether by requiring pre-approval of the rates or otherwise, charged by the person."

After debate, the question being put on the motion, it was agreed to.

On motion of Walt Lastewka, it was agreed, - That Clause 6, be amended by replacing, in the French version, lines 4 and 5 on page 5 with the following:

"à un fonds établi pour soutenir l'accès continu à des services de télécommunication de base aux"

On motion of Walt Lastewka, it was agreed, - That Clause 6, be amended by replacing, in the French version, line 11 on page 5 with the following:

"préalable, ainsi que la manière de gérer ce fonds."

Clause 6, as amended carried, on division.

On Clause 7

By unanimous consent, Walt Lastewka moved the following amendments concurrently:

That Clause 7, be amended by replacing line 19 on page 5 with the following:

"(b.1) prescribing classes of international telecommunica-"

That Clause 7, be amended by replacing line 21 on page 5 with the following:

"(b.2) requiring international telecommunications service"

And the question being put on the motions, they were agreed to, on division.

Clause 7, as amended, carried, on division.

By unanimous consent, Clauses 8 to 24 carried concurrently.

The Title carried.

The Bill, as amended, carried, on division.

ORDERED: That Bill C-17, An Act to amend the Telecommunications Act and the Teleglobe Canada Reorganization and Divestiture Act, as amended, be reprinted for the use of the House of Commons at Report Stage.

ORDERED: That the Chair report Bill C-17, with amendments, to the House.
