Pursuant to Standing Order 106(2), the clerk of the committee presided over the election of a vice-chair.

On motion of Dane Lloyd, it was agreed, — That Doug Shipley be elected First Vice-Chair of the committee.

The committee proceeded to the consideration of matters related to committee business.

The Chair presented the Fifth Report from the Subcommittee on Agenda and Procedure, which read as follows:

Your subcommittee met on Monday, September 25, 2023, to consider the business of the committee and agreed to make the following recommendations:

1. That clause-by-clause consideration of Bill C-20, An Act Establishing the Public Complaints and Review Commission and amending certain Acts and statutory instruments, start on Wednesday, September 27, 2023.

2. That five meetings, including one with the Minister of Public Safety, be dedicated to Bill C-26, An Act respecting cyber security, amending the Telecommunications Act and making consequential amendments to other Acts.

3. That members of the committee send their prioritized list of proposed witnesses for Bill C-26 to the clerk no later than Friday, October 6, 2023.

It was agreed, — That the Fifth Report from the subcommittee be concurred in.

Motion

Doug Shipley moved, — That the committee hold no less than five meetings to undertake a study on Paul Bernardo’s transfer from a maximum-security prison to a medium-security prison; that the committee invite the former Minister of Public Safety, Marco Mendicino, to appear alone for no less than two hours, to explain the transfer; that the committee invite Commissioner Anne Kelly and Deputy Minister Shawn Tupper to appear for no less than one hour to explain the transfer; and that the committee invite the current Minister of Public Safety to appear alone, for no less than two hours, to discuss what the government plans are to prevent transfers of dangerous offenders to a medium-security prison in the future, and that the Committee report their findings to the House.

Debate arose thereon.

Amendment

Jennifer O'Connell moved, — That the motion be amended by replacing the words “hold no less than five meetings to undertake a study on Paul Bernardo’s transfer from a maximum-security prison to a medium-security prison; that the committee invite the former Minister of Public Safety, Marco Mendicino, to appear alone for no less than two hours, to explain the transfer; that the committee invite Commissioner Anne Kelly and Deputy Minister Shawn Tupper to appear for no less than one hour to explain the transfer; that the committee invite the current Minister of Public Safety to appear alone, for no less than two hours, to discuss what the government plans are to prevent transfers of dangerous offenders to a medium-security prison in the future, and that the Committee report their findings to the House.” with the words “a meeting on the right of crime victims and the security reclassification and transfer of offenders within federal corrections, and that the committee invite Commissioner of Correctional Service Canada Anne Kelly, Deputy Minister Shawn Tupper, and officials of Justice and Public Safety Canada to appear”.

Debate arose thereon.

Subamendment

Dane Lloyd moved, — That the motion be amended by replacing the words “a meeting” with the words “no less than three meetings” and by adding after the words “that the committee invite” the following: “employees of the office of the Minister of Public Safety,” and by adding after the words “to appear“ the following “that representatives from victim family be invited to participate and that the Committee report to the House the result of its findings”.

Debate arose thereon.

At 5:33 p.m., the sitting was suspended.

At 5:56 p.m., the sitting resumed.

After debate, the question was put on the subamendment of Dane Lloyd and it was negatived, by a show of hands: YEAS: 4; NAYS: 7.

The committee resumed consideration of the amendment of Jennifer O'Connell, — That the motion be amended by replacing the words “hold no less than five meetings to undertake a study on Paul Bernardo’s transfer from a maximum-security prison to a medium-security prison. Amendment

Dane Lloyd moved, — That the motion as amendment be amended by adding after the words “Public Safety Canada” the following: “, the Correctionnal Investigator of Canada and the Federal Ombudsman for victims of crime,”.

At 6:48 p.m., the committee adjourned to the call of the Chair.
