Pursuant to the Order of Reference of Monday, June 10, 2019, the Committee resumed consideration of Bill C-101, An Act to amend the Customs Tariff and the Canadian International Trade Tribunal Act.

The Committee commenced its clause-by-clause study of the Bill.

The Chair called Clause 1.

Clause 1 carried on division.

On new Clause 1.1,

Pierre Poilievre moved, — That Bill C-101 be amended by adding after line 25 on page 1 the following new clause:

“1.1 Section 58 of the Act is renumbered as subsection 58(1) and is amended by adding the following:

(2) All amounts paid and collected under the United States Surtax Order (Steel and Aluminum) and the United States Surtax Order (Other Goods) on goods imported from the United States shall be used to compensate economic loss incurred by domestic steel producers and other industries as a result of tariffs imposed by the United States on Canadian steel and aluminum products.”

The Chair ruled the proposed amendment inadmissible because it was beyond the scope of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

Whereupon, Pierre Poilievre appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was sustained on the following recorded division:

YEAS: Rachel Bendayan, Peter Fragiskatos, Michael V. McLeod, Blake Richards, Kim Rudd, Francesco Sorbara — 6;

NAYS: Todd Doherty, Pierre Poilievre — 2.

Pierre-Luc Dusseault moved, — That Bill C-101 be amended by adding before line 1 on page 2 the following new clause:

“1.1 Subsection 2(1) of the Canadian International Trade Tribunal Act is amended by adding the following in alphabetical order:

domestic producer includes the employees of a domestic producer and any person or association acting on behalf of those employees; (producteur national)”

The Chair ruled the proposed amendment inadmissible because it was beyond the scope of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

Clause 2 carried on division.

On new Clause 2.1,

Pierre-Luc Dusseault moved, — That Bill C-101 be amended by adding after line 19 on page 2 the following new clause:

“Report to Parliament

2.1 (1) If no order has been made under subsection 55(1) of the Customs Tariff in respect of concrete reinforcing bars, energy tubular products, hot-rolled sheets, pre-painted steel or wire rods within four months after the day on which this section comes into force, the Minister of Finance must cause a report to be tabled before each House of Parliament on any of the first 15 days on which that House is sitting after the expiry of that four-month period.

(2) The report must include the reasons why no order has been made.”

The question was put on the amendment of Pierre-Luc Dusseault and it was negatived, by a show of hands: YEAS: 1; NAYS: 5.

Pierre-Luc Dusseault moved, — That Bill C-101 be amended by adding after line 19 on page 2 the following new clause:

“Report to Parliament

2.1 (1) The Minister of Finance must prepare a report containing an assessment of the impact on employment in Canada of the use of steel from domestic and foreign producers in the construction, maintenance and repair of public works, federal real property and federal immovables.

(2) The Minister must table the report in each House of Parliament within six months after the day on which this section comes into force.”

The question was put on the amendment of Pierre-Luc Dusseault and it was negatived, by a show of hands: YEAS: 1; NAYS: 5.

Pierre-Luc Dusseault moved, — That Bill C-101 be amended by adding after line 19 on page 2 the following new clause:

“Report to Parliament

2.1 (1) The Minister of Finance must prepare a report containing an assessment of the sufficiency of the resources allocated to the Canada Border Services Agency for the administration and enforcement of the program legislation, as defined in section 2 of the Canada Border Services Agency Act, with respect to steel.

(2) The Minister must table the report in each House of Parliament within six months after the day on which this section comes into force.”

The question was put on the amendment of Pierre-Luc Dusseault and it was negatived, by a show of hands: YEAS: 1; NAYS: 5.

Clause 3 carried on division.

The Title carried.

The Bill carried.

ORDERED, — That the Chair report the Bill to the House.

It was agreed, — That a proposed budget in the amount of $4,500, for the study of Bill C-101, An Act to amend the Customs Tariff and the Canadian International Trade Tribunal Act, be adopted.
