Pursuant to the Order of Reference of Thursday, October 19, 2017, the Committee resumed consideration of Bill C-57, An Act to amend the Federal Sustainable Development Act.

The Committee commenced its clause-by-clause study of the Bill.

The Chair called Clause 1.

The witness answered questions.

Clause 1 carried by a show of hands: YEAS: 6; NAYS: 0.

Clause 2 carried by a show of hands: YEAS: 6; NAYS: 0.

On Clause 3,

Mark Gerretsen moved, — That Bill C-57, in Clause 3, be amended by

(a) replacing line 16 on page 2 with the following:

based on an efficient use of natural, social

(b) adding after line 19 on page 2 the following:

(a.1) the principle that sustainable development

(i) is a continually evolving concept,

(ii) may be achieved by, among other things, the protection of ecosystems, prevention of pollution, protection of human health, promotion of equity, conservation of cultural heritage, respect for domestic and international obligations relating to sustainable development and recognition of the present generation’s responsibility to provide future generations with a healthy and ecologically sound environment, and

(iii) may be advanced by, among other things, taking into account the precautionary principle, the “polluter pays” principle, the principle of internalization of costs and the principle of continuous improvement;

(c) deleting lines 24 to 38 on page 2.

Debate arose thereon.

The question was put on the amendment of Mark Gerretsen and it was agreed to, by a show of hands: YEAS: 5; NAYS: 0.

Linda Duncan moved, — That Bill C-57, in Clause 3, be amended by replacing line 43 on page 2 to line 2 on page 3 with the following:

“(g) the principles contained in the United Nations Declaration on the Rights of Indigenous Peoples;”

Debate arose thereon.

The question was put on the amendment of Linda Duncan and it was negatived, by a show of hands: YEAS: 1; NAYS: 8.

Linda Duncan moved, — That Bill C-57, in Clause 3, be amended by adding after line 11 on page 3 the following:

“(j) the principle of adherence to the United Nations Resolution A/RES/70/1 “Transforming our world: the 2030 Agenda for Sustainable Development”;

(k) the principle of prevention, which is the principle that environmental measures must anticipate, prevent and address the causes of environmental degradation;

(l) the principle of non-regression, which is the principle providing that environmental laws, regulations and standards should not be weakened;

(m) the principle of environmental justice, which is the principle that environmental impacts should be equitably distributed among all Canadians; and

(n) the principle of the right to a healthy and ecologically balanced environment.

Debate arose thereon.

The question was put on the amendment of Linda Duncan and it was negatived, by a show of hands: YEAS: 1; NAYS: 8.

Clause 3, as amended, carried by a show of hands: YEAS: 5; NAYS: 0.

On Clause 5,

Linda Duncan moved, — That Bill C-57, in Clause 5, be amended by replacing line 17 on page 4 with the following:

(a) replacing line 22 on page 4 with the following:

6 (1) Subsections 9(1) and (2) of the Act are replaced

(b) adding after line 2 on page 5 the following:

(2) Subsection 9(4) of the Act is replaced by the following:

(4) The Minister shall at the same time submit the draft of the Federal Sustainable Development Strategy to the Commissioner for review and comment, including as to whether each target is measurable and includes a time frame, for which the Minister shall allow a period of not less than 120 days.

Linda Duncan moved, — That Bill C-57, in Clause 6, be amended by replacing line 24 on page 4 with the following:

Mike Bossio moved, — That Bill C-57, in Clause 8, be amended by replacing line 18 on page 5 with the following:

“10.2 The Queen's Privy Council for Canada may establish policies or issue directives applicable to one or more of the designated entities in relation to the environmental, social and economic impacts of their policies and operations and may establish policies or issue directives to ensure that performance-based contracts with the Government of Canada include provisions for meeting all of the targets referred to in the Federal Sustainable Development Strategy and the Departmental Sustainable Development Strategies.”

That Bill C-57, in Clause 8, be amended by adding after line 27 on page 7 the following:

“12.4 Performance-based contracts with the Government of Canada shall include provisions for meeting all of the targets referred to in the Federal Sustainable Development Strategy and the Departmental Sustainable Development Strategies.”
