The Standing Committee on Justice and Human Rights met at 3:31 p.m. this day, in Room 268, The Valour Building, the Chair, Mike Wallace, presiding.

 

Members of the Committee present: Françoise Boivin, Blaine Calkins, Sean Casey, Bob Dechert, Robert Goguen, Ève Péclet, Kyle Seeback, Mike Wallace and David Wilks.

 

Acting Members present: Hon. Lawrence MacAulay for Sean Casey and Philip Toone for Pierre Jacob.

 

In attendance: Library of Parliament: Sandra Gruescu, Analyst; Dominique Valiquet, Analyst.

Pursuant to the Order of Reference of Wednesday, October 29, 2014, the Committee commenced consideration of Bill S-221, An Act to amend the Criminal Code (assaults against public transit operators).
 

The Hon. Bob Runciman, Michael Roschlau and Neil Dubord, by videoconference from Burnaby, British Columbia, made statements and, with Matthew Taylor, answered questions.

 

The Committee commenced its clause-by-clause study of the Bill.

 

Clause 1 carried.

 

The Title carried.

 

The Bill carried.

Pursuant to the Order of Reference of Friday, June 20, 2014, the Committee resumed consideration of Bill C-32, An Act to enact the Canadian Victims Bill of Rights and to amend certain Acts.
 

Pamela Arnott answered questions.

 

The Committee resumed its clause-by-clause study of the Bill.

 

By unanimous consent, Clauses 31 to 34 inclusive carried severally.

 

On Clause 35,

Sean Casey moved, — That Bill C-32, in Clause 35, be amended by replacing line 24 on page 29 with the following:

Robert Goguen moved, — That Bill C-32 be amended by adding after line 40 on page 38 the following new clause:

“42.1 The amendment to paragraph 718.2(e) of the Act made by section 24 of this Act applies only in respect of sentences imposed in respect of conduct engaged in on or after the day on which that section 24 comes into force. ”

 

After debate, the question was put on the amendment of Robert Goguen and it was agreed to, by a show of hands: YEAS: 9; NAYS: 0.

On Clause 45,

Pursuant to the order adopted by the Committee on Tuesday, October 29, 2013, the following amendment, submitted by Elizabeth May for the consideration of the Committee, was deemed moved:

“of the victim's death cohabiting with them, having so cohabited”

“(f) any other individual who a court has, on application by that individual, determined to be an appropriate individual to exercise the victim’s rights on behalf of the victim.”

That Bill C-32, in Clause 49, be amended by replacing lines 37 and 38 on page 43 with the following:

“49. (1) Section 140 of the Act is amended by adding the following after subsection (4):

(4.1) Despite subsection (4) but subject to subsection (5), the victim of an offence shall be permitted to attend as an observer at a hearing relating to the offender, subject to such conditions as the Board or the person referred to in subsection (4) considers appropriate, unless the Board or the person is satisfied that one or more of the possible situations described in subsection (4) is likely to exist.

(2) Subsection 140(6) of the Act is repealed.”
