Monday, November 21, 2005

The Standing Committee on Aboriginal Affairs and Northern Development met at 3:30 p.m. this day, in Room 701, La Promenade Building, the Chair, Lloyd St. Amand, presiding.

Members of the Committee present: Bernard Cleary, Jeremy Harrison, Nancy Karetak-Lindell, Pat Martin, Serge Ménard, Jim Prentice, Carol Skelton, Lloyd St. Amand and Roger Valley.

Acting Members present: Don H. Bell for David Smith.

In attendance: Library of Parliament: Marlisa Tiedemann, Analyst.

Appearing: Hon. Sue Barnes, Parliamentary Secretary to the Minister of Indian Affairs and Northern Development and Federal Interlocutor for Métis and Non-Status Indians.

Witnesses: Department of Justice: Andrew Beynon, General Counsel and Manager, Legal Services. Fort McKay First Nation: Jim Boucher, Chief. Department of Indian Affairs and Northern Development : Paul Fauteux, Director General, Lands Branch; Paul Landry, Director, Legislative Projects. Pursuant to the Order of Reference of Friday, November 18, 2005, the Committee commenced consideration of Bill C-71, An Act respecting the regulation of commercial and industrial undertakings on reserve lands.

Pursuant to Standing Order 75(1), consideration of Clause 1 is postponed.

The Chair calls Clause 2.

The Parliamentary Secretary made a statement and, with the other witnesses, answered questions.

Jim Boucher and Peter Manywounds made statements and, with the other witnesses, answered questions.

Clause 2 carried.

On Clause 3,

Pat Martin moved, — That Bill C-71, in Clause 3, be amended by replacing lines 21 and 22 on page 2 with the following:

“(b) confer any administrative power on any person or”

After debate, the question was put on the amendment of Pat Martin and it was negatived.

On Clause 3,

Pat Martin moved, — That Bill C-71, in Clause 3, be amended by replacing line 27 on page 4 with the following:

“terms and conditions of such dispositions, providing that any such dispositions be voluntary on the part of the person or body holding such right or interest;”

After debate, the question was put on the amendment of Pat Martin and it was negatived.

On Clause 3,

Pat Martin moved, — That Bill C-71, in Clause 3, be amended by replacing line 30 on page 4 with the following:

“and Gas Act providing that the members of the First Nation holding the beneficial interest in the reserve lands approve the exclusion by referendum; and”

After debate, the question was put on the amendment of Pat Martin and it was negatived.

On Clause 3,

Pat Martin moved, — That Bill C-71, in Clause 3, be amended by deleting lines 31 to 37 on page 4.

After debate, the question was put on the amendment of Pat Martin and it was negatived.

Clause 4 carried.

On Clause 5,

Pat Martin moved, — That Bill C-71, in Clause 5, be amended by replacing line 11 on page 5 with the following:

“Council the making of specific regulations, providing that the approval has been provided by the members of the First Nation of the Council resolution; and”

After debate, the question was put on the amendment of Pat Martin and it was negatived.

Pat Martin moved, — That Bill C-71, in the Preamble, be amended by deleting lines 11 to 13 on page 1.

After debate, the question was put on the amendment of Pat Martin and it was negatived.

The Bill carried.

It was agreed, — That the Chair report Bill C-71 to the House.
