Meeting No. 3

Wednesday, November 20, 2002

The Standing Committee on Justice and Human Rights met at 3:44 p.m. this day, in Room 536, Wellington Building, the Chair, The Hon. Andy Scott, presiding.

Members of the Committee present: Carole-Marie Allard, Garry Breitkreuz, Chuck Cadman, The Hon. Hedy Fry, Ivan Grose, Derek Lee, Peter MacKay, Paul Harold Macklin, John Maloney, John McKay, The Hon. Andy Scott, Kevin Sorenson, Vic Toews.

Acting Members present: Mario Laframboise for Richard Marceau, Mac Harb for Lynn Myers, Carmen Provenzano for Irwin Cotler.

In attendance: From the Library of Parliament: Philip Rosen, senior analyst.

Witnesses: From the House of Commons: Bob Mills, Red Deer.  From the Department of Justice: Marilyn Bongard, Acting Senior Counsel, Family, Children and Youth Section, Policy Sector.

Pursuant to its Order of Reference of Monday, October 21, 2002, consideration of Bill C-231, An Act to amend the Divorce Act (limits on rights of child access by sex offenders)

Bob Mills made a statement and answered questions.

After debate, it was agreed that the Committee postpone clause-by-clause consideration of Bill C-231 until the beginning of 2003.

Kevin Sorenson moved - That the Committee on Justice and Human Rights request the appearance of the Solicitor General,  the Commissioner of Correctional Services Canada, the Correctional Investigator and the National Parole Board to provide a status report on what, if any, recommendations of the May 2000, Sub-Committee on Corrections and Conditional Release Act of the Standing Committee on Justice and Human Rights have been implemented and to defend inaction on those recommendations yet to be implemented.

After debate, it was agreed - That the motion be amended by deleting the words “Solicitor General” and by adding, in English only, before the words “National Parole Board”, the word “Chairperson.”

The question being put on the amended motion, it was agreed to.

Kevin Sorenson moved -- That the Committee on Justice and Human Rights undertake a review of the New Brunswick Commission of Inquiry, established by Order-In-Council 92-1022, regarding allegations of institutional misconduct at the New Brunswick Training School (Kingsclear) and report to Parliament.

 

Debate arose thereon.

At 5:03 p.m., the sitting was suspended

 

At 5:05 p.m., the Committee proceeded to sit in camera.

 

After debate, it was agreed – That the Committee study the issue of conditional sentencing.

 

After debate, it was agreed – That the Committee undertake a study on marriage and the legal recognition of same-sex unions.

 

After debate, it was agreed – That the Minister of Justice be invited to appear before the Committee before Christmas on the issue of marriage and the legal recognition of same-sex unions; and that the Committee begin its hearings after Christmas.

 

After debate, it was agreed – That the Committee consider Bill C-250 after Christmas.

 

At 5:10 p.m., the Committee adjourned to the call of the Chair.
