Questions and responses 42nd Parliament, 1st session December 3, 2015, to September 11, 2019

With regard to the Trans Mountain Pipeline Expansion Project Ministerial Panel: (a) what is the planned budget for the panel; (b) how many of its meetings will take place with stakeholders; (c) how many of its meetings will be open to the public, and for each, what advertising was undertaken to make the public aware of the meeting; (d) for each of its meetings, what are the (i) date, (ii) location, (iii) number of people attending, (iv) organizations represented by attendees and contributors, (v) costs associated with the attendance of a Minister or ministerial staff member, (vi) travel-related costs associated with the attendance of departmental staff, (vii) aggregated costs dispersed to organizations or individuals in order to support their attendance at or contribution to the meeting, (viii) total cost associated with the meeting not already listed, including for room rentals, catering, translation, provision of documentation, and other related costs; and (e) what is total spending to date on the panel?

With regard to the Trans Mountain Pipeline Expansion Project: (a) what are the details of any consultations or meetings which have been held with stakeholders, including the (i) date, (ii) locations, (iii) attendees; (b) what are the details of any briefing notes or correspondence related to the meetings referred to in (a), including the (i) title, (ii) date, (iii) sender, (iv) recipient, (v) subject matter, (vi) file number; (c) what is the content of any information provided to the Prime Minister by (i) the Department of Natural Resources, (ii) the Department of Environment and Climate Change, (iii) the Department of Public Safety and Emergency Preparedness, (iv) the Department of Finance, (v) the Department of Indigenous and Northern Affairs, (vi) the Department of Justice, (vii) the Department of Transport, (viii) the Department of Finance; (d) what is the content of any information provided to the Minister of Natural Resources and his parliamentary secretary by the Department of Natural Resources; (e) what is the content of any information provided to the Minister of Justice and her parliamentary secretaries by the Department of Justice; and (f) what is the content of any information regarding the Trans Mountain Pipeline Expansion Project provided to the Minister of Environment and her parliamentary secretary by the Department of Environment and Climate Change?

With regard to the cancellation of the Enbridge Northern Gateway: (a) what scientific data were provided with regard to the impacts of the proposed pipeline route subsequent to the approval of this project by the Joint Review Panel in 2014; (b) how did this additional scientific input contradict the science that supported the original decision by the Joint Review Panel; and (c) what were the (i) potential consequences identified by this new scientific input, (ii) the risk or likelihood that these consequences would occur, (iii) the likelihood that additional conditions or measures intended to mitigate could have reduced these risks to an acceptable level?

With regard to the twinning of the Trans Mountain Pipeline and the statement made multiple times by the Prime Minister in the House on February 13, 2018, that “We will get the pipeline built”: (a) when will the government get the pipeline built; and (b) how many kilometers of the pipeline expansion were built or completed in the 2018 calendar year?

With regard to the Trans Mountain Pipeline Expansion Project Ministerial Panel: (a) what compensation was provided to each member of the panel; (b) what were the itemized expenses filed by each member of the panel; (c) what were the itemized expenses incurred by the committee in each city where a public meeting was held; and (d) what were the total expenses incurred by the advisory panel?

With regard to the government’s recent approval and future efforts to facilitate the construction of Kinder Morgan’s Trans Mountain pipeline: (a) which federal and provincial government agencies, departments, and services has the government met with regarding the implementation of the pipeline; (b) what are the dates on which the meetings in (a) took place; and (c) what were the topics or subjects discussed at each of the meetings in (a)?

With regard to government advertising for oil pipeline projects, including approved projects and projects in the evaluation phase, since November 4, 2015: what is the total amount spent on advertising, broken down by (i) year, (ii) pipeline project, (iii) department, (iv) advertising platform, (v) supplier?

With regard to the Trans-Mountain Pipeline Expansion Project: (a) when is construction expected to resume on the pipeline; and (b) when will the expansion project be completed?

With regard to Environment and Climate Change Canada’s sponsorship of events and organizations which are opposed to the Trans Mountain Pipeline since November 4, 2015: (a) what is the complete list of such events and organizations which received funding from the government; (b) for each event and organization in (a), what are the details, including (i) name, (ii) date, (iii) title and description of event or organization, (iv) amount provided by the government; and (c) for each sponsorship, what is the government’s justification for providing funding to anti-pipeline entities?

With regard to the approval of Kinder Morgan’s Trans Mountain Expansion Project: what measures, if any, do the government and the National Energy Board plan to take to ensure that it be built with Canadian-made steel?

With regard to the Trans Mountain Pipeline Expansion Project: what are the details of all the consultations with First Nations, broken down by date, location, name and title of the First Nations, groups, or individuals consulted, conducted by (i) the Prime Minister, (ii) the Minister of Indigenous Affairs and the Department of Indigenous and Northern Affairs, (iii) the Minister of Natural Resources and the Department of Natural Resources, (iv) the Minister of Justice and Department of Justice?

With regard to the statement made by the Minister of Natural Resources in the House of Commons on October 2, 2017, that “the Energy East project will be considered and assessed under exactly the same criteria as the Enbridge Line 3 expansion and as the Trans Mountain expansion”: (a) what are the exact same criteria under which all three projects were considered and assessed; and (b) were there any variations in regard to the criteria used to consider and assess the three various projects and, if so, what were the variations?

With regard to the mandate letter of the Minister of Natural Resources, the National Energy Board (NEB) review process, and Kinder Morgan’s current application to expand the Trans Mountain pipeline: (a) what “new, fair processes” will Kinder Morgan’s Trans Mountain application be subject in order to: (i) “restore robust oversight and thorough environmental assessments”, (ii) “ensure that decisions are based on science, facts, and evidence”, (iii) ensure that decisions “serve the public’s interest”, (iv) “provide ways for Canadians to express their views”, (v) provide “opportunities for experts to meaningfully participate”, (vi) “enhance the engagement of indigenous groups in reviewing and monitoring major resource development projects”, (vii) “require pipeline proponents to choose the best technologies available to reduce environmental impacts”; (b) will the deadline for the NEB to issue its recommendations on Kinder Morgan’s Trans Mountain application be extended as a result; (c) will Canadians who were previously rejected by the NEB to be public commentators or intervenors on Kinder Morgan’s Trans Mountain application be given an opportunity to re-apply; (d) will the new review process take into account the potential climate change impacts of Kinder Morgan’s Trans Mountain pipeline expansion; (e) will the new review process take into account the economic consequences of the recent decrease in oil prices on Kinder Morgan’s Trans Mountain pipeline expansion; and (f) will the new review process maintain the Minister’s power under the National Energy Board Act to overrule the final recommendations of the NEB as to whether Kinder Morgan’s Trans Mountain pipeline expansion should be approved and the terms and conditions that would apply to the project?

With regard to the Northern Gateway Project: what consultations did the government undertake with the 31 First Nations and Métis communities who constitute the Aboriginal Equity Partners between October 19, 2015, and November 29, 2016, including the (i) date of meeting, (ii) location, (iii) First Nation or Métis community present, (iv) itemized breakdown of costs related to each meeting, (v) summary for each meeting?

With regard to the proposed Eagle Spirit Energy Corridor project for a pipeline between Fort McMurray, Alberta, and Grassy Point, British Columbia: (a) has the government conducted an analysis of the impact of Bill C-48, the Oil Tanker Moratorium Act, on the proposed project and, if so, what are the details of such an analysis, including the findings; and (b) will the government exempt vessels transporting oil in relation to the project from the moratorium proposed in Bill C-48?

With regard to the Prime Minister's instructions, in his mandate letter to the Minister of Indigenous and Northern Affairs, that the latter should implement the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP): (a) is it the government's policy to "consult and cooperate in good faith with the indigenous peoples concerned through their own representative institutions in order to obtain their free and informed consent prior to the approval of any project affecting their lands or territories and other resources, particularly in connection with the development, utilization or exploitation of mineral, water or other resources"; (b) is it the government’s policy to adhere to the principles of the UNDRIP before it is formally implemented; (c) given the Site C Clean Energy Project’s expected impacts on Aboriginal people, is it the government’s policy to (i) meet with the affected First Nations to hold discussions on treaty infringements, (ii) review the original decision to approve the Site C project, (iii) hold approvals and authorizations until a time when free, prior, and informed consent has been obtained; (d) is it the government's policy that the principle of free, prior, and informed consent will apply with respect to the approval of future pipeline and resource-extraction projects; (e) by what standard does government policy interpret the principle of free, prior, and informed consent; and (f) is it the government’s policy that the principle of free, prior, and informed consent shall apply with respect to the approval of projects under Interim Measures for Pipeline Reviews, and specifically to (i) Trans Mountain Expansion Project, (ii) Energy East Project?

With regard to the pipelines passing through the region of Vaudreuil-Soulanges: (a) since 2008, how many hydrostatic tests and any other safety tests (integrity, corrosion, etc.) have been conducted on all the pipelines over their entire length from Ontario to Quebec, broken down by (i) pipeline, (ii) type of test, (iii) date, (iv) federal entity or contractor, (v) test location and province, (vi) test result; (b) when requesting flow reversal for the 9B and Trans-Northern pipelines, did the government or any other entity calculate the greenhouse gas emissions upstream and downstream of the project; (c) if the answer in (b) is affirmative, what are the upstream and downstream emissions for each of the projects; (d) since 2008, how many leaks have there been on all the pipelines, in either Ontario or Quebec, broken down by (i) pipeline, (ii) location and province; (e) for each of the leaks in (d), what is (i) the quantity of the spill in litres, (ii) the company responsible for the pipeline, (iii) the direct or indirect cost to the federal government, (iv) the date of the spill, (v) the date on which the government or one of its regulatory agencies became aware of the spill; (f) since 2008, have the official emergency response plans been sent to the municipal public safety authorities and the regional county municipality for each of these pipelines; (g) if the answer in (f) is affirmative, for each plan sent, what is (i) the date it was sent, (ii) the date of confirmation of receipt, (iii) the names of the sender and the recipient; (h) since 2008, what are the details of all the cases of non-compliance, deficiencies and violations of federal laws and regulations found by the National Energy Board with respect to the pipelines, including (i) the date, (ii) a description of the deficiency found and the corrective action requested, (iii) the location of the deficiency, (iv) the pipeline and the name of the company that owns the pipeline, (v) the amount of the fine paid; (i) for each case of non-compliance, deficiency or violation in (h), on what exact date did the National Energy Board or a federal government department follow up with the respective companies and verify that the corrective action had been carried out; (j) for each follow-up in (i), what actions were taken; (k) since 2008, how many detection system failures have been identified by the National Energy Board on the pipelines and what are the details of each failure, including (i) the date, (ii) the pipeline, (iii) the location, (iv) the reason for the failure; (l) for each pipeline, in the event of a spill in the Soulanges area, what is the expected time (i) to detect it, (ii) to stop the flow of oil, (iii) for emergency services to arrive on site; and (m) where are the companies that have been hired to respond to a spill in the Soulanges area and how long will it take them to arrive on site?
