I'd like someone, whether one of the officials or clerks, or perhaps the analyst, to tell us whether the proposed NDP amendment will force the government to include language clauses in future funding agreements with the provinces and territories, or whether its intent is simply to have the government hold consultations, without becoming law.
Can anyone confirm this?
J'aimerais que quelqu'un, que ce soit l'un des fonctionnaires ou des greffiers, ou encore l'analyste, nous dise si l'amendement proposé par le NPD va forcer le gouvernement à inclure des clauses linguistiques dans les futures ententes concernant des investissements dans les provinces et les territoires, ou s'il vise simplement à ce que le gouvernement envisage de tenir des consultations, sans que cela ait force de loi.
Quelqu'un pourrait-il confirmer le tout?

In 2022, the Federal Court of Appeal handed down a decision in the matter opposing the Fédération francophone de la Colombie-Britannique and the Government of Canada. If a similar case were to arise in future, would amendment NDP‑8 mean that the decision handed down would be complied with or would it amount to what Ms. Boyer just mentioned, which is that the government would simply have an obligation to consult the provinces and territories? The decision demonstrated that, in spite of this obligation, the federal government had not taken the measures needed to include language clauses in the agreement, or that the measures it took were inadequate.
Am I wrong in saying that amendment NDP‑8, if adopted, would not not include anything that would prevent a decision like the 2022 ruling in the case opposing the francophone communities of British Columbia and the Government of Canada?

En 2022, la Cour d'appel fédérale a rendu un jugement dans l'affaire opposant la Fédération francophone de la Colombie‑Britannique et le gouvernement du Canada. Si un cas similaire devait se produire dans l'avenir, est-ce que l'amendement NDP‑8 signifierait qu'on respecterait le jugement rendu, ou est-ce que cela reviendrait à ce que Mme Boyer vient de mentionner, c'est-à-dire que le gouvernement aurait tout simplement une obligation de consulter les provinces et les territoires? Ce jugement a démontré que, malgré cette obligation, le gouvernement fédéral n'avait pas pris les moyens nécessaires pour inclure des clauses linguistiques dans l'entente, ou que celles qu'elle contenait n'étaient pas suffisantes.
Est-ce que je me trompe ou est-ce que l'amendement NDP‑8, s'il était adopté, ne ferait rien de plus pour éviter un jugement comme celui de 2022 dans la cause opposant les communautés francophones de la Colombie‑Britannique et le gouvernement du Canada?

So I have the committee's consent to say a few words. It won't be long, because I get the feeling that I will not have an opportunity to introduce my amendment. I am just going to make a comment.
I have been listening to the discussion for a while and I would first like to thank the members of the committee for their work. Everyone knows how important this bill is for francophones everywhere in Canada. I sincerely hope you will find a solution so you have more time and so that some extremely important amendments can be debated, like the ones about the language clauses that have been called for by all francophone advocacy groups in Canada. In fact, I will have an amendment to propose on that subject, but there will be others.
As an independent MP who is not taken any side on this subject, I ask that you find a consensus for extending this meeting by more than an hour. Everything possible needs to be done for francophone and anglophone minorities and for this bill to be satisfactory and for it to be possible to pass it officially in the House of Commons and then the Senate.
J'ai donc le consentement du Comité pour dire un petit mot. Ce ne sera pas long, car j'ai l'impression que je n'aurai pas l'occasion de déposer mon amendement. Je vais juste faire un commentaire.
J'écoute les débats depuis tantôt, et je veux d'abord remercier les membres du Comité de leur travail. Tout le monde sait l'importance de ce projet de loi pour les francophones partout au pays. Je souhaite sincèrement que vous trouviez une solution pour que vous ayez plus de temps et pour que des amendements extrêmement importants, comme ceux concernant les clauses linguistiques demandées par tous les organismes de défense des francophones au pays, puissent être débattus. D'ailleurs, j'aurai un amendement à proposer à ce sujet, mais il y en aura d'autres.
À titre de député indépendant n'ayant aucun parti pris sur le sujet, je vous prie de trouver un consensus pour prolonger cette réunion de plus d'une heure. Il faut faire tout ce qui est possible pour les francophones et les anglophones en situation minoritaire et pour que ce projet de loi soit satisfaisant et puisse être adopté officiellement à la Chambre des communes et, par la suite, au Sénat.
