Thank you to all three of the witnesses.
We've all really enjoyed having witnesses here on this particular bill, but I think we all feel a little frustrated as well, because this is not leading to any changes in this legislation. This is the way it is right now in Parliament.
I want to go to the future, because quite obviously all three of you have said that this is not adequate. What would be adequate for first nations? What is the direction first nations want out of this type of legislation? Where do first nations want to go, as nations and as governments?
I think I heard pretty clearly, Chief Thunder, about where you want to go.
Could I just get from each one of you a snapshot of where you think first nations want to go, from your experience and your understanding? That includes Mr. Shanks, who's worked on the other side for quite a number of years.

J'aimerais simplement que chacun de vous me donne une idée de ce que les Premières nations voudraient, d'après votre expérience et votre compréhension des faits. Ma question s'adresse aussi à M. Shanks, qui a travaillé de l'autre côté pendant de nombreuses années.

Thank you, Mr. Chair.
I've found this discussion to be fascinating. I sat for a number of years on an environmental assessment board in the Northwest Territories. I know there are some things that are different between CEAA and the Mackenzie Valley Resource Management Act. One of the key elements, and I think this relates to a very important principle in our country, is the cumulative impact assessment. Within CEAA there were opportunities to look at future developments. If we had a mine in one area, and two or three other mines were being planned in that area, we could look at them and see what the combined impact of those mines would be, for example, on caribou herds. The linear disturbance of those might change the feature.
In the new act, is there any sense that we will be looking at future developments, that we will be considering the cumulative impact of developments? We're living in a world where there are seven billion people. We're living in a world where you're talking about hundreds of billions of dollars of investment in this country.
What is your industry's take on cumulative impact assessment? How does it fit in with what's happened in this bill?

Je trouve que notre discussion est fascinante. Depuis un certain nombre d'années, je suis membre d'une commission d'évaluation environnementale dans les Territoires du Nord-Ouest. Je sais qu'il y a quelques différences entre la LCEE et la Loi sur la gestion des ressources de la vallée du Mackenzie. L'un des éléments clés — qui renvoie, selon moi, à un principe très important au Canada — est l'évaluation des effets cumulatifs. Sous le régime de la LCEE, on avait la possibilité d'envisager les travaux prévus dans l'avenir — si une mine était exploitée à un endroit, et que l'on prévoyait en exploiter deux ou trois autres dans le même secteur, nous pouvions prendre ces dernières en considération et examiner quel serait l'effet combiné de ces mines, par exemple, sur les troupeaux de caribous. L'éventuelle perturbation linéaire de ces troupeaux pouvait amener des changements au chapitre de la façon de procéder.
Est-ce que cette idée de prendre en considération les travaux d'exploitation futurs et les effets cumulatifs de ces travaux est présente dans les nouvelles dispositions législatives? La Terre compte sept milliards d'habitants. Des centaines de milliards de dollars sont investis dans notre pays.
Quel est le point de vue de votre industrie sur l'évaluation des effets cumulatifs? Dans quelle mesure ce point de vue concorde-t-il avec les modifications apportées par le projet de loi?

Is it unreasonable when you're developing a project to look at the induced impacts of that project, to look at all the things that happen around it?

Under this legislation, do you feel that mining companies will be responsible for taking into account these regional studies when they happen? Is there any timeframe for those to take place so that we can put the context to regional development? Is there any sense that development must follow the creation of a regional context?

If the regional assessment hasn't taken place, should the mining developments then take place in the absence of data about how induced development is going to occur? What do you want to put first here, the environment or development?
