Good afternoon, everyone. I'll start with Mr. Pink or Ms. Finestone.
The Elizabeth Fry Society states that administrative segregation isn't necessary, whereas the John Howard Society, the correctional officers and the Correctional Service of Canada maintain that it's sometimes necessary.
In your opinion, does Bill C-83 seek to eliminate segregation or to ensure the safe and secure implementation of segregation?

The other piece, which I'm getting from all of the responses, is that I think that's why the courts come back. I think there are two reasons the courts come back—and perhaps Professor Parkes could comment on this. One is the fact that you get to the point, with abusive punishment, where you are influencing the sentencing decision that was made by a court in the first place. The other piece, just in order to give it teeth, which I think is a concern here, is that you get all of these reports. We know it's an issue whenever we get media stories of people who have self-harmed and all of these horrifying situations, but ultimately would you agree that the issue has to do with an ability to actually enforce any kind of recommendation that's made?
I don't know if you share it, but my understanding is that the bill doesn't allow for any recommendation by a health care professional or anyone else but a warden or the commissioner to be enforceable.

Do you have a proposal in terms of the hours spent outside the cell? What number of hours would be more reasonable than the minimum of four hours? What should that number of hours be to reduce the difference between the number of hours for regular units and for segregation units?

I thank all three of you for being here.
I have a few questions on some of the language that is in, or not in, the legislation. I'll just throw them out there and ask for a response from both you, Senator, and our friends from the Canadian Civil Liberties Association.
The first is the absence of the term “least restrictive” that was in Bill C-56, which was also flawed legislation, but that's not what we're here to discuss.
The other piece of language that I wanted to hear from all three of you about is in proposed paragraph 32(a), which talks about “for security or other reasons”. That's something that I've asked multiple witnesses about because I have a concern that it continues the status quo of using this type of confinement to compensate for other systemic issues in our corrections system.
Can I hear all three of you—or both of you, however you divvy it up—on both of those two language issues in the legislation?

I'm going to dive right into the issue of structured intervention units. I have had the pleasure of visiting institutions with my colleague in the past, and my impression was that administrative segregation was a major reprimand, the end of the line, but when they explained to us why people are put in segregation, it was clear that the reasons are much more complex and diverse than we thought. People are put in segregation for safety and mental health reasons, but sometimes it's because the inmates themselves request it. People are put in segregation due to circumstances that vary significantly from case to case.

This matter was raised about two years ago, and one of the major issues then was the number of days spent in administrative segregation. Under this bill, administrative segregation of an individual must end as soon as possible even if the individual is in a structured intervention unit.
How does the nuance in the bill address the thorny issue of number of days in segregation? I'm not 100% sure, but I think this came up at the UN.
People are put in structured intervention units in order to meet needs that we used to think, perhaps wrongly, were being met under the old system and to give them access to external programs and interventions.
How can we reduce the number of days an inmate has to spend in an SIU?

There are a number of points I would like to raise.
The first pertains to solitary confinement or administrative segregation, as the case may be. You are of course aware of the case in British Columbia that the government has appealed.
I know it is up to the Department of Justice to decide whether or not to appeal a decision. That said, from your point of view, what would prevent us from introducing a bill in the House of Commons to require the application of the standards stipulated by the court, standards that would be consistent with the United Nations guidelines on the treatment of prisoners?

Yes, I am referring to the case in British Columbia. The judge ruled recently in favour of the British Columbia Civil Liberties Association. He ruled that stricter standards must be applied for the use of solitary confinement. The government filed an appeal in this case.
Is there something in your organization that would stand in the way of the court decision being implemented immediately? A bill to this effect would of course have to be passed.

As Ms. Bergen pointed out, our speaking time is limited. I would say that mine is especially limited since I am the only NDP member on this committee.
I would simply like to know if you have any information to the effect that the government should not go along with the United Nations, which recommended limiting administrative segregation to 15 days and implementing a more robust mechanism for offenders to appeal a decision. Do you have any information that such measures could pose a threat to correctional officers, for instance? This would not take effect overnight, of course, but could stricter criteria be established right away for the use of solitary confinement?
