Mr. Speaker, ultimately, that is the big issue we have here. We have raised this issue several times.
One of the reasons we see the abusive use of solitary confinement in our federal corrections system is the lack of resources. That is one of the things that came back repeatedly during the study of the bill, because we are looking at completely reformatting how our prison system operates but are bringing administrative segregation back under a different name. After repeated questioning, both the minister and the officials were unable to explain to us how much funding would be available or how all of this would be implemented. That is problematic as there is enough fine print in this legislation that, in the event there is a lack of resources to deal with offenders who have serious mental health issues, the only recourse would be to put them in solitary confinement.
The government is going to respond, through the amendments it has brought at report stage, by saying not to worry and that it is dealing with it because there is a review mechanism. However, the problem with that review mechanism is that we are looking at 30 days after an initial decision has been made; 30 days again, after which it goes to another committee; and another 30 days after that. Therefore, it is nowhere near respecting the United Nations' norms and the Mandela rules. Rather, it is going to deal with all of this bureaucracy that ultimately is undermining mental health outcomes and the rights of these individuals.
Monsieur le Président, en fin de compte, c'est ce qui nous préoccupe le plus dans le projet de loi. Nous avons soulevé cet enjeu à plusieurs reprises.
Le manque de ressources explique en partie le recours abusif à l'isolement dans le système correctionnel fédéral. C'est un sujet qui a été abordé à maintes reprises durant l'étude du projet de loi parce que nous cherchons à transformer complètement le fonctionnement de notre système carcéral, mais que nous allons poursuivre la pratique de l'isolement préventif sous un autre nom. Après des questions répétées, ni le ministre ni ses collaborateurs n'ont pu préciser combien d'argent au juste serait disponible ou comment toutes ces mesures seraient mises en oeuvre. C'est problématique parce que le projet de loi contient suffisamment de subtilités que, s'il manque des ressources pour s'occuper des délinquants ayant de graves problèmes de santé mentale, la seule solution serait de les placer en isolement.
En réponse à ces préoccupations, le gouvernement a proposé des amendements à l'étape du rapport qui disent, fondamentalement, qu'il fait le nécessaire puisqu'il y a un mécanisme d'examen, et qu'il n'y a donc pas lieu de s'inquiéter. Le problème avec le mécanisme d'examen, c'est qu'il s'écoule 30 jours après la décision initiale, encore 30 jours avant que le cas soit soumis à un autre comité, puis encore 30 jours. On est donc loin de respecter les normes des Nations unies et les Règles Mandela. Il faudrait plutôt repenser toute cette bureaucratie qui porte atteinte à la santé mentale et aux droits des personnes concernées.
