You said it already exists. Is it used strictly when an accident occurs or all the time, in other words, from the moment the train leaves the station?

I'm talking about two different things. First, there is the video and voice recording system. Second, there is an event recorder, which has been in place since the 1980s and can be used to obtain reference data and information on the train's behaviour at any time. The information is also available in the case of accidents or internal investigations by Transport Canada or the Transportation Safety Board of Canada.
Je parle de deux choses différentes. D'une part, il y a un système d'enregistrement vidéo et d'enregistrement des voix. D'autre part, il y a l'enregistreur d'événements, qui est en place depuis les années 1980, qu'on peut utiliser pour avoir des références et des informations concernant la conduite du train à n'importe quel moment. C'est aussi disponible lors d'accidents ou d'enquêtes internes effectuées par Transports Canada ou par le Bureau de la sécurité des transports du Canada.

We heard you say in your preamble that movement on things like cameras and voice recorders in the cabs is something you would like to see go forward. My guess is that you're running into opposition from the bargaining units because of what they say is their experience with whistle-blowers being reprimanded, and they would be concerned that this kind of technology, as opposed to being a safety measure, would be used in disciplinary processes. How do you respond to that?

Our employees have a number of protections. They have an internal ombudsman. They have external.... They can go to the TSB. They can work through the union. There are lots of ways to handle it if a company were ever to go over and above what they need to do to correct behaviour for the employees. That's not our philosophy. Our philosophy is to change people's behaviour using the minimum amount of discipline, and it's important for us to stay there.
The second reason we want to use the cameras inward is that it gives us a view of the cab. We're talking about fatigue. We can study it. We don't want the cameras on all the time. We want to do it in a SMS system. We want to be able to take a look at what's happening in the cab. We want to be able to study it properly.
Nos employés ont un certain nombre de protections. Ils ont un ombudsman interne. Ils ont des recours externes... Ils peuvent se présenter au BST. Ils peuvent collaborer avec le syndicat. Il y a beaucoup de façons de gérer cela, si jamais une société souhaite aller au-delà de ce qu'elle doit faire pour corriger le comportement des employés. Ce n'est pas notre philosophie. Nous avons pour principe de changer le comportement des gens en ayant recours au moins de discipline possible, et c'est important pour nous de nous en tenir à cela.
La deuxième raison pour laquelle nous souhaitons utiliser les enregistreurs vidéo dans les locomotives, c'est que cela nous donne un aperçu de ce qui s'y passe. Nous parlons de la fatigue. Nous pouvons l'étudier. Nous ne voulons pas que les enregistreurs vidéo soient allumés en tout temps. Nous voulons le faire dans un SGS. Nous voulons être en mesure d'examiner ce qui se passe dans la cabine. Nous voulons être en mesure de l'étudier correctement.

The answer is not black and white. If you find employees and people who are breaking the rules or the law of Canada, like blowing the whistle, it is hard for you not to be able to deal with that in the appropriate manner. It could be a mistake; it could be whatever. It's a silly question to say, “Are we going to stop and have technology in place?” What it does is it makes us safer. It allows us to analyze what's happening in the cab. It's proven that if we can view what's happening in the cab or even outside with other systems we have in place, we're able to operate a safer railroad. That's what we want.
Il n'y a pas de réponse absolue. Si vous apercevez des employés et des personnes qui enfreignent les règles ou la loi du Canada, comme dans le cas de dénonciateurs, il est difficile de ne pas pouvoir gérer cela de la façon appropriée. Il pourrait s'agir d'une erreur; il pourrait s'agir de n'importe quoi. I can't really talk about the study because I'm under observer status for the TSB. There is a study going on right now, a safety study. I can tell you that our position is that we have no objections to LVVR being installed and operating under the current protections of the Transportation Accident Investigation and Safety Board Act. Our concern is that when those tapes get released to the carrier for viewing and compliance, that's going to create safety hazards and silent cabs. I talked about our members' fears about reporting safety issues. They're going to be focused on that camera. That camera is going to be on them for 12 hours a day. They're going to be focused on that camera, and it's going to distract them from their duties. They're not going to communicate with their co-worker for fear that everything is being recorded and it's Big Brother. Everything will recorded and your boss is going to see that all day long.
Je ne peux pas vraiment parler de l'étude, en raison de ma situation d'observateur pour le BST. Une étude se déroule en ce moment même sur la sécurité. Je peux vous dire que notre position est que nous ne nous opposons pas à l'installation des enregistreurs de conversations et des enregistreurs vidéo ni à leur exploitation sous le régime des mesures de protection qu'accorde actuellement la Loi sur le Bureau canadien d'enquête sur les accidents de transport et de la sécurité des transports. Nous craignons que lorsque les bandes seront communiquées au transporteur pour visionnement et contrôle de la conformité, ça créera des risques pour la sécurité et mettra en place, dans les locomotives, la loi du silence. J'ai parlé des craintes de nos membres relativement au signalement des problèmes de sécurité. La caméra se concentrera sur eux. Elle les enregistrera 12 heures par jour. Elle les détournera de leurs tâches. Ils ne communiqueront pas avec leurs collègues, de crainte que tout soit enregistré. Ce sera Big Brother. Tout sera enregistré, et le patron le visionnera toute la journée.

There are a significant number of issues that are being looked at in terms of the study that's going on right now. Some of those issues address the technical issues; what are the standards? If you're going to mandate a particular type of equipment, what kind of equipment? What kind of reliability? What kind of durability of recordings, etc.? What's the positioning? What's the placement? What is the data that you want to gather? There are a number of areas to be looked at there.
There are also areas to be looked at in terms of the objectives of the safety and fatigue information, and what other kinds of information might come out of this. In general, what is attempted to be achieved with the use of the recorders?
Then there is the issue of how that correlates with the employees who would be subject to the surveillance of those video recorders. There's a good body of work out in the public and from the various privacy commissioners and others as to some of those issues, and they do come under a variety of umbrella legislation in other areas as well that should be looked at.
Finally, there are the regulatory issues and the legislative issues that would be required to put in place an appropriate regulatory regime. There are many questions to be addressed at this stage.
Un nombre assez considérable de problèmes sont examinés dans le cadre de l'étude actuellement en cours. Pour ce qui est des problèmes de nature technique, on s'interroge sur les normes. Par exemple, si on impose un type d'équipement en particulier, de quel genre d'équipement s'agira-t-il? Quelle en sera la fiabilité? Quelle sera entre autres la durabilité des enregistrements? Où cet équipement sera-t-il placé? Quel genre de données souhaite-t-on recueillir? De nombreux facteurs doivent être pris en compte.
Il faut également s'interroger sur les objectifs de l'information sur la sécurité et la fatigue, et voir quel autre genre de renseignements il est possible d'obtenir. De façon générale, il faut se demander quel résultat vise l'utilisation des enregistreurs?
Par ailleurs, il faut tenir compte des employés qui seront soumis à la surveillance de ces enregistreurs vidéo. De nombreux travaux sur la question, notamment par des commissaires à la protection de la vie privée, font état de problèmes à examiner qui relèvent de diverses lois-cadres dans d'autres domaines.
Enfin, les enjeux réglementaires et législatifs exigent la mise en place d'un régime réglementaire approprié. Il reste de nombreux problèmes à régler.
