What is the level of trust right now between indigenous peoples and the RCMP in Canada? Have you been keeping statistics on that and understanding surveys about that? Obviously that's a very important consideration. If someone's not willing to make a complaint, why are they not willing?

I'd like to thank each and every one of you for coming to testify here at this committee. I can say personally I'm very moved and very concerned by what I've heard.
I don't think this is the Canada that people really associate with our nation, yet I've heard, laid out by Dr. Stote and also the lawyer for the plaintiffs, the Native Women's Association and also the Michif women's association, some terrible allegations concerning what would constitute genocide. Sterilization was mentioned 23 times in the report, but I don't think we delved enough into it to truly understand.
I was just wondering how many investigations you are aware of that are being conducted by the RCMP right now concerning forced sterilization. Does anyone have an answer?

I know NWAC has a strong position on that, related to, for instance, who is a status Indian and who is not a status Indian. There was even a bill before Parliament, Senate Bill S-3, which looked at enlarging the number of people who were supposed to receive status. That would repair a lot of the things in the past.
Is that stopping a government policy that was really about eliminating or removing indigenous peoples from their roles and assimilating them into Canadian society?

We did hear in some testimony that customary adoption is still practised in many indigenous communities, but currently, in a number of locations and jurisdictions across Canada, in fact, there is no mention of it in law. This introduced significant challenges to indigenous peoples when they tried customary adoption. This is a traditional form of child-rearing. When it's used in ceremony with elders, and done in an appropriate way, it confers responsibility on new parents. It's often used in communities.
Often, the courts have found that, because it's not mentioned in Canadian law at any level, except perhaps in Quebec or in the Far North, this represents significant challenges for them to understand, and represents significant costs to legalize, in the western way, customary adoption. The purpose of this is to ensure that it is mentioned somewhere in some federal statute, that it actually does exist and it is important.

In common law, from my research when I was a professor at the University of Manitoba, there is precedent in common law where judges do refer to it, and it is referred to in a few cases. The issue is often judges who are less experienced with indigenous law, especially in child and family law, are not always aware of some of that common law and so it becomes problematic for people then to.... Because there's no reference, they have a reticence or a lack of an ability to approve something, so it takes many court dates and lots of funds on the parts of parents in order to legalize themselves, because there is absolutely no reference.
