One of the key principles underlying responsible parliamentary government is that the House of Commons holds the power of the purse. This amendment that we're proposing will make the tabling of a budget with financial information mandatory to give MPs time to assess the budget before the beginning of the fiscal year. With the public relations brochures we get from time to time in the form of economic action plans, which are devoid of detailed accounting, and with budgets tabled in April instead of February and March, this government has eroded parliamentarians' ability to perform their duty in holding the government accountable on spending.

L'un des grands principes à la base d'un gouvernement responsable veut que la Chambre des communes tienne les cordons de la bourse. L'amendement que nous proposons rendra le dépôt d'un budget contenant des renseignements de nature financière obligatoire pour permettre aux députés d'avoir le temps d'évaluer le budget avant le début de l'exercice. Les brochures de relations publiques que nous recevons de temps en temps et qui prennent la forme de plan d'action économique ne nous offrent aucune information comptable détaillée, et en présentant ses budgets en avril plutôt qu'en février et en mars, le gouvernement mine la capacité des parlementaires de s'acquitter de leur obligation, qui est de demander des comptes au gouvernement par rapport aux dépenses.

We can't have or we shouldn't have a government that's afraid to borrow to build the infrastructure we need because it's worried about the penalties that might occur. This amendment will make it so this legislation is careful not to restrict borrowing for prudent capital investment.

Le gouvernement ne peut pas ou ne devrait pas avoir peur d'emprunter pour bâtir les infrastructures dont nous avons besoin parce qu'il est inquiet des pénalités que cela pourrait entraîner. L'amendement vise à faire en sorte que le projet de loi ne limite pas les emprunts ayant trait à des investissements prudents dans les immobilisations.

This amendment deletes the clauses within the bill that will allow for secret evidence as well as evidence inadmissible in a Canadian court of law. It also requires an appellant to be informed of the minister's case against them, not just “reasonably informed”.

This amendment appoints a special advocate to be present whenever an appellant and their counsel can't be present due to issues of national security. This is the scheme from security certificates. In my opinion, these secret trials are unjust, but at least a special advocate would make things a bit more fair.

L'amendement vise la nomination d'un avocat spécial qui sera présent lorsqu'un appelant et son avocat ne peuvent l'être pour des raisons de sécurité nationale. Il s'agit du mécanisme découlant des certificats de sécurité. À mon avis, ces procès secrets sont injustes, mais la présence d'un avocat spécial rendrait au moins les choses un peu plus justes.

Again, this amendment deletes the clauses within the bill that allow for secret evidence and for decisions to be made based on evidence that neither the opponent nor the counsel has even seen.
It also requires the opponent to be actually informed of the minister's case, and not just “reasonably informed”.
Encore une fois, cet amendement supprime les dispositions du projet de loi qui permettent de garder des éléments de preuve secrets et font en sorte que les décisions sont prises en fonction d'éléments de preuve que ni la partie adverse ni l'avocat ont jamais vus.
Ces dispositions exigent également que la partie adverse soit réellement informée de la preuve du ministre, non pas simplement « raisonnablement informée ».

This amendment appoints a special advocate to be present whenever an appellant and their counsel cannot be present due to issues of national security. If we have enough information to revoke somebody's passport, we should have enough to look into charges of laying a recognizance without conditions. A special advocate would at least make sure that the person accused who can't defend themselves has someone looking out for them.
Cet amendement vise à ce qu'un avocat spécial soit nommé et qu'il soit présent dans tous les cas où un demandeur et son conseil ne peuvent être présents en raison d'enjeux liés à la sécurité nationale. Si nous possédons suffisamment d'information pour révoquer le passeport d'une personne, nous devrions en avoir suffisamment pour savoir s'il y a déjà eu des accusations ayant exigé des engagements assortis de conditions. Un avocat spécial pourrait au moins s'assurer que la personne accusée, si elle ne peut se défendre elle-même, bénéficie quand même de l'aide d'un tiers.

There are very good reasons for and against extending privilege to patent agents. However, this needs to happen in a separate intellectual property bill, partly because it's extremely controversial. In the meantime, things could be clearer if these common law principles were present here. This amendment seeks to incorporate the elements of the Wigmore test.

Il existe de très bonnes raisons pour lesquelles on devrait ou on ne devrait pas accorder le privilège du secret professionnel aux agents de brevets. Toutefois, il faudrait le faire par le truchement d'un projet de loi distinct, portant sur la propriété intellectuelle, en partie en raison du fait que cette question suscite une énorme controverse. D'ici là, ce serait plus clair si on intégrait ici les principes de common law. Avec cet amendement, on pourrait intégrer les volets du critère de Wigmore.

This one will be very short.
This amendment would do exactly the same thing as PV-14 but for trademark agents. I should perhaps use that bit of extra time to explain the Wigmore test. It was summarized by the Supreme Court in 1991, in the Gruenke case:
The Wigmore test as to whether or not a communications is privileged requires that: (1) the communications must originate in a confidence that they will not be disclosed; (2) this element of confidentiality must be essential to the full and satisfactory maintenance of the relation between the parties; (3) the relation must be one which in the opinion of the community ought to be [diligently] fostered; and (4) the injury...to the relation by the disclosure of the communications must be greater than the benefit thereby gained for the correct disposal of litigation.

Cet amendement aurait exactement les mêmes résultats que le PV-14, mais il concerne les agents de marques de commerce. Je devrais peut-être profiter du temps supplémentaire qui m'est accordé pour expliquer le critère de Wigmore. Voici comment la Cour suprême l'a résumé, en 1991, dans l'arrêt Gruenke:

Together is fine. It makes sense, they do the same thing.
This bill changes the years of copyright for a song recording, not a song, but a recording from 50 years to an astounding 70 years. The big three foreign record companies lobbied the Prime Minister directly for this, and this came hidden here in this omnibus budget bill with no study or consultation.
Our amendments will change it back to 50 years, still very long, but more reasonable. Numerous studies in Europe have shown that extending the copyright for sound recordings does not benefit artists at all, but does benefit the big record labels. The artists quite often don't hold the copyright for the sound recording, while they do for the actual song, which goes for 50 years after death.

Je vais parler des deux amendements en même temps. Cela me semble sensé, ils visent le même résultat.
Le projet de loi prolonge la période de protection des enregistrements sonores, je ne parle pas des chansons, mais des enregistrements sonores, de 50 ans à 70 ans, ce qui est renversant. Les trois grandes maisons de disque étrangères ont fait pression directement sur le premier ministre, dans ce dossier, et les amendements se sont glissés clandestinement dans le projet de loi omnibus sur le budget, sans qu'il n'y ait eu d'études ni de consultations.
Les amendements que nous proposons visent à ramener cette période à 50 ans, qui est quand même très longue, mais qui est plus raisonnable. De nombreuses études menées en Europe ont révélé que la prolongation de la période de protection des enregistrements sonores ne procure absolument aucun avantage aux artistes eux-mêmes, mais en procure aux grandes compagnies de disque. Assez souvent, ce ne sont pas les artistes qui détiennent les droits de propriété intellectuelle des enregistrements sonores, mais ils détiennent les droits sur la chanson elle-même, qui est protégée jusqu'à 50 ans après leur décès.

This amendment seeks to do two things, as recommended by James Haga, VP of Engineers without Borders. The first is poverty reduction, and specifically that Canada's development goals should be at the very heart of the development finance initiative's, DFI's, core mandate. Second, DFIs' investments should complement but be quite distinct from Canada's official development assistance.

Avec cet amendement, nous visons deux objectifs, comme le recommande James Haga, vice-président de l'organisation Ingénieurs sans frontières. Le premier objectif, c'est la réduction de la pauvreté, c'est-à-dire plus précisément que les objectifs du Canada en matière de développement devraient être au coeur même du mandat de l'Initiative de financement du développement. Le second objectif, c'est que les investissements consentis au titre de cette initiative devraient compléter l'aide au développement que fournit officiellement le Canada, mais en être distincts.

This amendment doesn't have anything to say about pay or non-pay, and it's very simple and straightforward. It emphasizes part of the point that Mr. Rankin was making, that on this point alone legislation would be better than regulation and make it certain.
This amendment will make sections 247.1 to 247.4 of the Canada Labour Code applicable to federal interns, and these are the sexual harassment provisions only.

Cet amendement n'a rien à voir avec le fait d'être payé ou de ne pas l'être, et il est très simple et direct. Il fera ressortir une partie de l'argument qu'avançait M. Rankin, selon lequel sur ce point seulement, la loi serait mieux que le règlement et apporterait de la certitude à cet égard.
Cet amendement rendra les articles 247.1 à 247.4 du Code canadien du travail applicables à tous les stagiaires fédéraux, et il ne s'agit que des dispositions concernant le harcèlement sexuel.

I'll start with amendment PV-27. We have serious and deep reservations on two major points. The first is the potential for such a service to unintentionally place what is now wholly legislative jurisdiction, the protection of parliamentary privilege, into the hands of the executive.

Sorry. I stand corrected. Thank you very much.
This amendment would undo the change proposed by Bill C-59 to expand the maximum natural gas exportation licence to 40 years from the current maximum which is 25. Recognizing the importance of responsible and sustainable resource development, this change would mean that all stakeholders would get fewer opportunities to revisit projects that had previously received approval, depending on their positive or negative impact on the environment and economies of the communities that they affect.
As West Coast Environmental Law, a B.C. environmental law advocacy group that opposes the change, says, “It is quite possible that something thought to be a good idea today may not be in 25 years' time with the advent of climate change, economic shifts, increasingly harmed environment, and other potentially unforeseen alterations to the landscape. By lengthening the maximum term of licencing we're removing our ability to revisit these important questions and continue to ensure that our decisions are working to the advantage of everyone.”

Cet amendement annulerait la modification proposée par le projet de loi C-59 visant la prorogation de la durée maximale des licences d'exportation de gaz naturel à long terme de 25 ans à un maximum de 40 ans. Compte tenu de l'importance de l'exploitation responsable et durable des ressources, cette modification supposerait que tous les intervenants auraient moins de possibilités de revoir les projets qui ont déjà été approuvés, en fonction de leurs répercussions favorables ou défavorables sur l'environnement et l'économie des collectivités visées.
Comme l'a dit la West Coast Environmental Law Association, un groupe de défense du droit de l'environnement qui s'oppose à la modification, il est fort possible que quelque chose qui semble une bonne idée aujourd'hui ne le soit peut-être pas dans 25 ans avec l'arrivée du changement climatique, les changements économiques, les dommages croissants à l'environnement et d'autres altérations éventuelles imprévues du paysage. En prorogeant la durée maximale des licences, nous éliminons notre capacité de revoir ces enjeux importants et de continuer de faire en sorte que nos décisions soient bénéfiques pour tout le monde.
