Petition to the House of Commons

Whereas:
  • Many Canadian citizens face lengthy divorce proceedings, often due to complex legal issues such as child custody and property division, which prevent them from obtaining the divorce certificate required by Immigration, Refugees and Citizenship Canada (IRCC) for a valid immigration sponsorship;
  • These extended delays force individuals to incur significant legal expenses, and the lack of a final divorce certificate leaves individuals in legal limbo, unable to remarry or make important life decisions; and
  • Current laws expose citizens to the risk of accusations of misrepresentation or polygamy under IRCC rules, despite their previous marriage being dissolved in practice due to the legal requirement to remain in a marriage on paper, even when all practical aspects of the relationship have ended.
We, the undersigned, citizens of Canada, call upon the House of Commons to:
1. Update Canada’s legal framework in collaboration with the provinces and territories to allow for greater flexibility in cases of lengthy divorce proceedings, taking into consideration the impact of family court rulings when determining eligibility to remarry;
2. Reform the law in collaboration with the provinces and territories to allow the relationship aspect of a marriage to be separated from other issues in lengthy divorce proceedings, so individuals can remarry once it has been established that the marriage is dissolved in a family court; and
3. Ensure that Canadian citizens are not at risk of accusations of misrepresentation or polygamy simply due to the extended length of time required to obtain a formal divorce certificate.
