The representative of Fisheries and Oceans confirmed that “the result of these changes has been a decrease in the navigability of the North Rustico Channel and the main entrance to North Rustico harbour.” (J. Morrisey, DFO, testimony)

Representatives of the North Rustico community informed the committee that as a result of the causeway and the reduced navigability of the channel and main entrance to the North Rustico harbour, the area has suffered significant economic losses. Proposals for the location of a state of the art crab processing facility in Rustico cannot proceed unless the water depth of the harbour is increased. The proponents for installing the eastern breakwater indicate that this facility would restore the traditional channel depth to between 10 and 12 feet. The expanding eco-tourism industry in the area would substantially improve if the corrective measures proposed were implemented. Rustico was identified as being one of the provinces significant tourist ports.

Les représentants de la collectivité de North Rustico ont informé le comité qu’en raison de la construction de la chaussée et de la baisse de la navigabilité dans le canal de North Rustico et à l’entrée principale de son port, le secteur a subi des pertes financières importantes. Des propositions pour l’emplacement d’installations modernes de transformation du crabe à Rustico ne peuvent être concrétisées à moins que la profondeur de l’eau dans le port n’augmente. Les promoteurs responsables de l’installation du brise‑lames dans l’est ont indiqué que cette installation ramènerait la profondeur du canal entre 10 et 12 pieds. In 1997 the Minister of Canadian Heritage established a Working Group, co-chaired by a representative from Parks Canada and the President of the North Queens Wildlife Federation which was tasked to develop options which would resolve the issue.

En 1997, le ministre du Patrimoine canadien a fondé un groupe de travail, coprésidé par un représentant de Parcs Canada et le président de la North Queens Wildlife Federation, qui a reçu pour mandat d’élaborer des solutions visant à résoudre le problème.

In 1998 the Working Group recommended to the Minister of Canadian Heritage the following:

Ø       Phase I — construction of a breakwater at the eastern end of Rustico island

Ø       Phase II — Removal of Robinson’s Island causeway

Ø       Phase III — reconstruction of a sandspit.

Ø       Étape I — construction d’une brise-lames dans la partie est de l’île Rustico

Ø       Étape II — enlèvement de la chaussée de l’île Robinson

Ø       Étape III — reconstruction du terrain sablonneux.

The scientific consultants and the Working Group further suggested that Phase I, the construction of the eastern breakwater be completed and following completion of that phase that the subsequent impact be studied prior to any undertaking of phases II or III.

Les experts-conseils scientifiques et le groupe de travail ont suggéré de terminer l’étape I, soit la construction du brise-lames dans la partie est, et d’étudier par la suite les répercussions du projet avant d’entreprendre les étapes II et III.

Following receipt of the recommendations and the submission of those findings to the Minister of Canadian Heritage, the Minister, called upon DFO to undertake the construction of the breakwater at the eastern entrance to Rustico Channel as Parks Canada mandate was to protect the natural heritage resources and cultural resources of the national park.” (Mr. D. Après avoir reçu les recommandations et présenté ces constatations au ministre du Patrimoine canadien, celui-ci a fait appel au MPO pour qu’il entreprenne la construction du brise‑lames à l’entrée est du canal Rustico puisque le mandat de Parcs Canada est de « protéger les ressources patrimoniales naturelles et culturelles du parc national. » (M. D. In response DFO through the Minister stated:

En réponse, le Ministre, au nom du MPO, a déclaré :

“the scientific work funded by your department [Canadian Heritage] and recommendations of the working group clearly indicate that the channel and bay areas have deteriorated dramatically since the closure of Little Harbour channel by Parks Canada in 1956. In my view, funding of the works proposed should logically fall to the organization responsible for the original intervention.”

« Les recherches scientifiques financées par votre ministère [Patrimoine canadien] et les recommandations du groupe de travail indiquent clairement que le canal et la baie se sont nettement détériorés depuis la fermeture du canal de Little Harbour par Parcs Canada en 1956. Selon moi, l’organisation responsable de l’intervention d’origine devrait logiquement se porter garante du financement des travaux proposés » (traduction libre).

The Committee is of the opinion that while there appears to be a consensus as to the need to complete Phase I of the Working Group report, an impasse remains as to which federal department will fund the project.

Le Comité estime, même s’il semble y avoir un consensus en ce qui concerne la nécessité de terminer l’étape I du rapport du groupe de travail, la question du ministère responsable du financement est loin d’être réglée.

Therefore, the Committee recommends:

That the Minister of Canadian Heritage in cooperation with the Minister of Fisheries and Oceans as well as the Minister of Environment commit to a tripartite agreement to provide funding for a full environmental assessment based upon the implementation of the three phase report produced by the Working Group, beginning with Phase I.

Que la ministre du Patrimoine canadien en collaboration avec le ministre de Pêches et Océans ainsi que le ministre de l’Environnement s’engagent dans un accord tripartite pour assurer le financement d’une évaluation environnementale complète fondée sur la mise en œuvre du rapport sur les trois étapes élaboré par le groupe de travail, en commencant par la première étape.

That the Minister of Canadian Heritage and the Minister of Fisheries and Oceans reach a bilateral agreement to provide funding for the installation of a breakwater on the eastern entrance to Rustico Bay as recommended in Phase I of the Working Group Report.

Que la ministre du Patrimoine canadien et le ministre des Pêches et des Océans concluent un accord bilatéral en vue d’assurer le financement de l’installation d’un brise-lames à l’entrée est de la baie de Rustico, comme il est recommandé à l’étape I du rapport du groupe de travail.

That following the completion of Phase I, the federal government through the appropriate federal department undertake a full review of the impact of the eastern breakwater and if necessary complete Phase II and Phase III as prescribed by the Working Group Report.

Qu’après avoir terminé l’étape I, le gouvernement fédéral, par l’intermédiaire du ministère fédéral compétent, fasse l’examen complet des répercussions du brise-lames dans la partie est, et si nécessaire, termine les étapes II et III, prescrites dans le rapport du groupe de travail.
