In accordance with its Order of Reference of Thursday, October 28, 1999, your Committee has considered
Bill C-276, An Act to amend the Competition Act, 1998 (negative option marketing), and agreed on Thursday, February 17, 2000, to report it with the following amendments:

Conformément à son Ordre de renvoi du jeudi 28 octobre 1999, votre Comité a étudié le projet de loi C-276, Loi de 1998 modifiant la Loi sur la concurrence (commercialisation par abonnement par défaut), et a convenu le jeudi 17 février 2000, d'en faire rapport avec les amendements suivants:

Clause 1

Article 1

That Bill C-276, in Clause 1, be amended by replacing lines 5 and 6 on page 1 with the following:

Que le projet de loi C-276, à l'article 1, soit modifié par substitution, aux lignes 5 et 7, page 1, de ce qui suit :
"adding the following after section 74.05:

That Bill C-276, in Clause 1, be amended by replacing lines 15 to 25 on page 1 with the following:

"(b) a broadcasting undertaking within the meaning of the Broadcasting Act; and

Clause 2 is deleted.

That Bill C-276 be amended by adding after line 26 on page 3 the following new clause:

"2.1 The portion of subsection 74.1(6) of the Act before paragraph (a) is replaced by the following:

"(1.2) The Governor in Council may, by regulation, on the recommendation of the Minister of Canadian Heritage, exempt from the definition of "service" in section 74.051 any licensed service distributed on a broadcasting undertaking that, in the opinion of the Governor in Council, should be exempted in order to achieve the objectives set out in subsection 3(1) of the Broadcasting Act.
