Pursuant to the Order of Reference of Thursday, March 24, 2016, the Committee resumed consideration of Bill C-7, An Act to amend the Public Service Labour Relations Act, the Public Service Labour Relations and Employment Board Act and other Acts and to provide for certain other measures.

The Committee commenced its clause-by-clause study of the Bill.

The witnesses answered questions.

The Chair called Clause 1.

By unanimous consent, Clauses 1 to 32 inclusive carried severally.

On Clause 33,

Erin O'Toole moved, — That Bill C-7, in Clause 33, be amended by replacing line 3 on page 18 with the following:

“group only if it is satisfied on the basis of the results of a secret ballot representation vote that a majority of the employees in the bargaining unit who have cast a ballot have voted to have the employee organization represent them as their bargaining agent and that the employee organiza-”

After debate, the question was put on the amendment of Erin O'Toole and it was negatived on the following recorded division:

YEAS: Jim Eglinski, Cheryl Gallant, Erin O'Toole — 3;

NAYS: Daniel Blaikie, Pam Damoff, Nicola Di Iorio, Nathaniel Erskine-Smith, Marco Mendicino, Sven Spengemann — 6.

Daniel Blaikie moved, — That Bill C-7, in Clause 33, be amended by adding after line 23 on page 18 the following:

(4) For the purposes of subsection (2), an employee organization is considered to be affiliated with a bargaining agent or other association when:

(a) the employee organization joins or becomes a member of a bargaining agent or other association;

(b) the employee organization is bound together with or controlled by a bargaining agent or other association through constitutional obligations; or

(c) the employee organization engages in a relationship with a bargaining agent or other association in which the other party exercises a substantial degree of control, direction, or restriction on the activity of the employee organization. ”

After debate, the question was put on the amendment of Daniel Blaikie and it was negatived on the following recorded division:

YEAS: Daniel Blaikie — 1;

NAYS: Pam Damoff, Nicola Di Iorio, Jim Eglinski, Nathaniel Erskine-Smith, Cheryl Gallant, Marco Mendicino, Erin O'Toole, Sven Spengemann — 8.

Daniel Blaikie moved, — That Bill C-7, in Clause 33, be amended by adding after line 23 on page 19 the following:

After debate, the question was put on the amendment of Daniel Blaikie and it was negatived on the following recorded division:

NAYS: Pam Damoff, Nicola Di Iorio, Jim Eglinski, Cheryl Gallant, Marco Mendicino, Erin O'Toole, Sven Spengemann — 7.

Clause 33 carried.

By unanimous consent, Clauses 34 to 39 inclusive carried severally.

After debate, Clause 40 was negatived by a show of hands: YEAS: 0; NAYS: 9.

Clause 41 carried.

Clause 42 was negatived by a show of hands: YEAS: 0; NAYS: 9.

The Chair ruled that Clause 74 was consequential to Clauses 40 and 42 and therefore it was also negatived.

By unanimous consent, Clauses 43 to 73 inclusive carried severally.

The Title carried.

The Bill, as amended, carried.

ORDERED, — That the Chair report the Bill, as amended, to the House.

ORDERED, — That Bill C-7, as amended, be reprinted for the use of the House at report stage.
