Pursuant to the Order of Reference of Tuesday, June 13, 2017, the Committee commenced consideration of Bill S-3, An Act to amend the Indian Act (elimination of sex-based inequities in registration).

The Committee commenced its clause-by-clause study of the Bill.

Martin Reiher, Nathalie Nepton and Candice St-Aubin answered questions.

The Chair called Clause 1.

On Clause 1,

Arnold Viersen moved, — That Bill S-3, in Clause 1, be amended by replacing line 17 on page 1 with the following:

“any credible evidence, including the results of DNA analysis, that is presented by the applicant”

After debate, the question was put on the amendment of Arnold Viersen and it was negatived, by a show of hands: YEAS: 3; NAYS: 6.

Clause 1 carried.

On Clause 2,

Gary Anandasangaree moved, — That Bill S-3, in Clause 2, be amended by deleting lines 5 to 16 on page 2.

After debate, the question was put on the amendment of Gary Anandasangaree and it was agreed to, by a show of hands: YEAS: 6; NAYS: 1.

Clause 2, as amended, carried by a show of hands: YEAS: 6; NAYS: 1.

By unanimous consent, Clauses 3 to 9 inclusive carried severally by a show of hands: YEAS: 7; NAYS: 0.

By unanimous consent, Clauses 10 and 11 were stood severally.

Clause 12 carried.

Clause 13 carried.

Clause 14 carried.

Clause 15 carried.

At 10:08 a.m., the sitting was suspended.

At 10:18 a.m., the sitting resumed.

By unanimous consent, the Committee reverted to Clause 10 previously stood.

On Clause 10,

Romeo Saganash moved, — That Bill S-3, in Clause 10, be amended by replacing lines 36 and 37 on page 8 with the following:

“ages or indemnity from any employee or agent of Her Majesty in”

After debate, the question was put on the amendment of Romeo Saganash and it was negatived, by a show of hands: YEAS: 1; NAYS: 3.

Clause 10 carried.

On Clause 11,

Romeo Saganash moved, — That Bill S-3, in Clause 11, be amended by replacing line 31 on page 9 with the following:

ter of Rights and Freedoms, of the United Nations Declaration on the Rights of Indigenous Peoples and, if applicable, of”

After debate, the question was put on the amendment of Romeo Saganash and it was agreed to, by a show of hands: YEAS: 6; NAYS: 1.

Clause 11, as amended, carried by a show of hands: YEAS: 6; NAYS: 1.

On Title,

Cathy McLeod moved, — That Bill S-3 be amended by replacing the long title on page 1 with the following:

“An Act to amend the Indian Act in response to the Superior Court of Quebec decision in Descheneaux c. Canada (Procureur général)”

The question was put on the amendment of Cathy McLeod and it was agreed to, by a show of hands: YEAS: 9; NAYS: 0.

The Title, as amended, carried.

The Bill, as amended, carried.

ORDERED, — That the Chair report the Bill, as amended, to the House.

At 10:31 a.m., the sitting was suspended.

At 10:32 a.m., the sitting resumed in camera.

The Committee proceeded to the consideration of matters related to Committee business.

It was agreed, — That a proposed budget in the amount of $23,700, for the study of the subject matter of Bill C-17, An Act to amend the Yukon Environmental and Socio-economic Assessment Act and to make a consequential amendment to another Act, be adopted.

At 10:38 a.m., the Committee adjourned to the call of the Chair.
