Pursuant to the Order of Reference of Wednesday, October 19, 2016, the Committee commenced consideration of Bill C-238, An Act respecting the development of a national strategy for the safe disposal of lamps containing mercury.

Darren Fisher made a statement and answered questions.

At 4:23 p.m., the sitting was suspended.

At 4:24 p.m., the sitting resumed.

Virginia Poter made a statement and answered questions.

The Committee commenced its clause-by-clause study of the Bill.

Pursuant to Standing Order 75(1), consideration of Clause 1 (Short Title), is postponed.

The Chair calls Clause 2.

On Clause 2,

Mark Gerretsen moved, — That Bill C-238, in Clause 2, be amended by replacing lines 8 to 18 on page 1 with the following:

“ments and with representatives of other interested governments in Canada that are responsible for the environment, and in consultation with all interested persons or organizations that he or she considers appropriate, must develop a national strategy for the safe and environmentally sound disposal of lamps containing mercury. The strategy may include

(a) the identification of practices for the safe and environmentally sound disposal of those lamps;

(b) the establishment of guidelines for facilities where activities involved in the safe and environmentally sound disposal of those lamps are carried out; and

(c) the development of a plan to promote public awareness of the importance of those lamps being disposed of safely and in an environmentally sound manner.”

Debate arose thereon.

Garnett Genuis moved, — That the amendment be amended by replacing the word “may” with the word “must ”.

Debate arose thereon.

The question was put on the subamendment of Garnett Genuis and it was negatived, by a show of hands: YEAS: 4; NAYS: 5.

François Choquette moved, — That the amendment be amended by adding after the word “develop” the following:

“and implement, in conjunction with provinces and territories,”.

Debate arose thereon.

The question was put on the subamendment of François Choquette and it was negatived on the following recorded division:

YEAS: François Choquette, Garnett Genuis — 2; NAYS : John Aldag, William Amos, Mike Bossio, Jim Eglinski, Darren Fisher, Mark Gerretsen, Martin Shields — 7.

The Committee resumed consideration of the amendment of Mark Gerretsen, — That Bill C-238, in Clause 2, be amended by replacing lines 8 to 18 on page 1 with the following:

On motion of Mark Gerretsen, it was agreed, — That Bill C-238, in the short title, be amended by replacing line 5 on page 1 with the following:

Safe and Environmentally Sound Disposal of Lamps Containing Mercury Act.”

Clause 1, Short Title, as amended, carried.

On motion of Mark Gerretsen, it was agreed, — That Bill C-238 be amended by replacing the long title on page 1 with the following:

“An Act respecting the development of a national strategy for the safe and environmentally sound disposal of lamps containing mercury”.

The Title, as amended, carried.

The Bill, as amended, carried.

ORDERED, — That the Chair report the Bill, as amended, to the House.

ORDERED, — That Bill C-238, as amended, be reprinted for the use of the House at report stage.

At 5:26 p.m., the Committee adjourned to the call of the Chair.
