The Standing Committee on Environment and Sustainable Development met at 3:50 p.m. this day, in Room 209, West Block, the Chair, James Bezan, presiding.

 

Members of the Committee present: Scott Armstrong, James Bezan, Bernard Bigras, Blaine Calkins, Linda Duncan, Gerard Kennedy, Joyce Murray, Christian Ouellet, Francis Scarpaleggia, Mark Warawa and Stephen Woodworth.

 

Acting Members present: Ron Cannan for Steven Blaney, Ed Fast for Steven Blaney and Mario Silva for Gerard Kennedy.

 

In attendance: Library of Parliament: Kristen Douglas, Analyst; Tim Williams, Analyst. House of Commons: Wayne Cole, Legislative Clerk; David-Andrés Novoa, Procedural Clerk.

 
Pursuant to the Order of Reference of Wednesday, June 16, 2010, the Committee resumed consideration of Bill C-469, An Act to establish a Canadian Environmental Bill of Rights.
 

On motion of Linda Duncan, it was agreed, — That, pursuant to Standing Order 97.1(1), the Committee requests an extension of thirty sitting days to complete its study of Bill C-469.

 

The Committee resumed consideration of Clause 10 and the amendment of Francis Scarpaleggia, — That Bill C-469, in Clause 10, be amended by adding after line 12 on page 8 the following:

“(2) For greater certainty, the environmental information referred to in subsection (1) shall be made available to the public in addition to any information disclosed under the Access to Information Act.”

 

After debate, the question was put on the amendment of Francis Scarpaleggia and it was agreed to, by a show of hands: YEAS: 6; NAYS: 5.

 

Clause 10, as amended, carried on the following recorded division: YEAS: Bernard Bigras, Linda Duncan, Gerard Kennedy, Joyce Murray, Christian Ouellet, Francis Scarpaleggia — 6; NAYS: Scott Armstrong, Blaine Calkins, Ed Fast, Mark Warawa, Stephen Woodworth — 5.

 

On Clause 11,

Mark Warawa moved, — That Bill C-469, in Clause 11, be amended by replacing lines 17 to 19 on page 8 with the following:

“sion-making.”

 

After debate, it was agreed — That the amendment be amended by adding after the word “sion-making” the following: “solely because they lack a private or special legal interest in the matter”.

 

After debate, the question was put on the amendment of Mark Warawa, as amended, and it was negatived, by a show of hands: YEAS: 5; NAYS: 6.

 
Mark Warawa moved, — That Bill C-469, in Clause 11, be amended by replacing lines 13 and 14 on page 8 with the following:

“The Govern-”

 

After debate, the question was put on the amendment of Mark Warawa and it was negatived, by a show of hands: YEAS: 5; NAYS: 6.

 
Francis Scarpaleggia moved, — That Bill C-469, in Clause 11, be amended by replacing line 15 on page 8 with the following:

“ment of Canada shall not deny, oppose or otherwise contest any resident”

 

After debate, the question was put on the amendment of Francis Scarpaleggia and it was agreed to, by a show of hands: YEAS: 6; NAYS: 5.

 
Stephen Woodworth moved, — That Bill C-469, in Clause 11, be amended by replacing line 14 on page 8 with the following:

“in balanced and cost-effective environmental protection and economic development and the Govern-”

 

After debate, it was agreed, — That the amendment be amended by replacing the word “economic” with the word “sustainable”.

 

After debate, the question was put on the amendment of Stephen Woodworth, as amended, and it was negatived, by a show of hands: YEAS: 5; NAYS: 6.

 

Clause 11, as amended, carried on the following recorded division: YEAS: Bernard Bigras, Linda Duncan, Joyce Murray, Christian Ouellet, Francis Scarpaleggia, Mario Silva — 6; NAYS: Scott Armstrong, Blaine Calkins, Ed Fast, Mark Warawa, Stephen Woodworth — 5.

 

On Clause 12,

Stephen Woodworth moved, — That Bill C-469, in Clause 12, be amended by replacing line 22 on page 8 with the following:

“, the Government of Canada shall”

 

After debate, the question was put on the amendment of Stephen Woodworth and it was negatived, by a show of hands: YEAS: 5; NAYS: 6.

 
Francis Scarpaleggia moved, — That Bill C-469, in Clause 12, be amended by replacing line 22 on page 8 with the following:

“and registered, Canadian-controlled entities, the Government of Canada shall”

 

After debate, the question was put on the amendment of Francis Scarpaleggia and it was agreed to.

 

Debate resumed on Clause 12, as amended.
