The Standing Committee on Health met at 3:30 p.m. this day, in Room 269, West Block, the Chair, Joy Smith, presiding.

 

Members of the Committee present: Hon. Carolyn Bennett, Patrick Brown, Colin Carrie, Patricia Davidson, Nicolas Dufour, Kirsty Duncan, Luc Malo, Cathy McLeod, Joyce Murray, Joy Smith, Tim Uppal and Judy Wasylycia-Leis.

 

Acting Members present: France Bonsant for Luc Malo.

Associate Members present: Carol Hughes.

Pursuant to the Order of Reference of Wednesday, June 3, 2009, the Committee resumed consideration of Bill C-32, An Act to amend the Tobacco Act.

 

The witnesses made statements and answered questions.

 

Pursuant to Standing Order 75(1), consideration of Clause 1 is postponed.

The Chair calls Clause 2.

 

On Clause 2,

Joyce Murray moved, — That Bill C-32, in Clause 2, be amended by replacing line 8 on page 2, with the following:

“scribed to be a little cigar, but excludes any tobacco product that has no filter and that has a wrapper composed of natural leaf tobacco as well as a binder and a filler both composed of natural or reconstituted leaf tobacco.”

 

After debate, the question was put on the amendment of Joyce Murray and it was negatived, by a show of hands: YEAS: 1; NAYS: 9.

 

Clause 2 carried by a show of hands: YEAS: 10; NAYS: 0.

 

Clause 3 carried by a show of hands: YEAS: 10; NAYS: 0.

 

On Clause 4,

Colin Carrie moved, — That Bill C-32, in Clause 4, be amended by replacing line 27 on page 2 with the following:

“tobacco product or to display a marking required under this or any other Act of Parliament or of the legislature of a province or for any other prescribed purpose.”

 

After debate, the question was put on the amendment of Colin Carrie and it was agreed to, by a show of hands: YEAS: 10; NAYS: 0.

 

Clause 4, as amended, carried by a show of hands: YEAS: 10; NAYS: 0.

 

On Clause 5,

Colin Carrie moved, — That Bill C-32, in Clause 5, be amended by replacing lines 35 and 36 on page 2 with the following:

“product contains a colouring agent used for a purpose referred to in subsection 5.1(2).”

“(3) The Governor in Council shall, by order, amend the schedule to add any additive or tobacco product that it has been determined is being marketed to children.”

(b) by adding, after the reference to “citric acid (CAS 77-92-9) and its salts” in the portion of item 1 in column 1 on page 7, the following:

(c) by adding, after the reference to “l-menthone (CAS 14073-97-3)” in the portion of item 1 in column 1 on page 7, the following:

(d) by adding, after the reference to “propylene glycol (CAS 57-55-6)” in the portion of item 1 in column 1 on page 7, the following:

“– rosin glycerol ester (CAS 8050-31-5)

– sodium acetate anhydrous (CAS 127-09-3)”

(e) by adding, after the reference to “sodium alginate (CAS 9005-38-3)” in the portion of item 1 in column 1 on page 7, the following:

“– sorbic acid (CAS 110-44-1) and its salts”

(f) by adding, after the reference to “triacetin (CAS 102-76-1)” in the portion of item 1 in column 1 on page 7, the following:

“– tributyl acetylcitrate (CAS 77-90-7)”

(g) by replacing item 4 on page 7 with the following:

Nicolas Dufour moved, — That Bill C-32 be amended in the Schedule:

(a) by deleting, in item 1, in column 1, on page 7, the following:

“— menthol (CAS 89-78-1)

l-menthol (CAS 2216-51-5)

l-menthone (CAS 14073-97-3)”

(b) by adding item 13, in numerical order, on page 8;

(c) by adding, in column 1, as a corresponding reference to item 13, on page 8, the following:

“— menthol (CAS 89-78-1)

l-menthol (CAS 2216-51-5)

l-menthone (CAS 14073-97-3)”

(d) by adding, in column 2, as a corresponding reference to item 13, on page 8, the following:

“Little cigars and blunt wraps”

 

After debate, by unanimous consent, the amendment was withdrawn.
