The Standing Committee on Access to Information, Privacy and Ethics met in a televised session at 10:02 a.m. this day, in Room 237-C, Centre Block, the Chair, Paul Szabo, presiding.

 

Members of the Committee present: Hon. Charles Hubbard, Carole Lavallée, Pat Martin, Richard Nadeau, Paul Szabo, David Tilson and Mike Wallace.

 

Acting Members present: Dean Del Mastro for Dave Van Kesteren, Gary Goodyear for Russ Hiebert, Hon. Dominic LeBlanc for Sukh Dhaliwal, Pierre Lemieux for Dave Batters, Marcel Proulx for Glen Douglas Pearson and Hon. Karen Redman for Sukh Dhaliwal.

 

In attendance: Library of Parliament: Nancy Holmes, Analyst. House of Commons: Gregory Tardi, Parliamentary Counsel (Legal).

 

Witnesses: As individuals: David Campbell; Marilyn Dixon; Andrew Kumpf; Malcolm Ruby; Cynthia Downey; Steve Halicki; Darren Roberts.

 
Pursuant to S.O. 108(3)(h)(vi) and the motion adopted by the Committee on June 19, 2008, the Committee resumed its study of the Activities of the Conservative Party of Canada during the 2006 Election Campaign in relation to certain Election Campaign Expenses and the Ethical Standards of Public Office Holders.
 

A point of order was raised concerning the manner in which the Chair was recognizing Members on points of order.

 

RULING OF THE CHAIR

The Chair ruled that the Chair can exercise discretion as to when to recognize a Member on a point of order.

 

Whereupon, Gary Goodyear appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was sustained on the following recorded division: YEAS: Charles Hubbard, Carole Lavallée, Dominic LeBlanc, Pat Martin, Richard Nadeau, Marcel Proulx — 6; NAYS: Dean Del Mastro, Gary Goodyear, Pierre Lemieux, David Tilson, Mike Wallace — 5.

 

David Campbell, Marilyn Dixon and Andrew Kumpf, duly sworn in, made statements, answered questions and made closing statements.

 

A point of order was raised concerning the questioning of witnesses about matters relating to issues before the courts.

 

RULING OF THE CHAIR

The Chair ruled that the matter was not a point of order.

 

Whereupon, David Tilson appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was sustained on the following recorded division: YEAS: Charles Hubbard, Carole Lavallée, Pat Martin, Richard Nadeau, Marcel Proulx, Karen Redman — 6; NAYS: Dean Del Mastro, Gary Goodyear, Pierre Lemieux, David Tilson, Mike Wallace — 5.

RULING OF THE CHAIR

The Chair ruled that the matter was not a point of order.

 

Whereupon, David Tilson appealed the decision of the Chair.
