| In accordance with its Order of Reference of Wednesday, May 4, 2005, your Committee has considered Bill C-38, An Act respecting certain aspects of legal capacity for marriage for civil purposes, and agreed on Wednesday, June 15, 2005, to report it with the following amendments: | Conformément à son Ordre de renvoi du mercredi 4 mai 2005, votre Comité a étudié le projet de loi C-38, Loi concernant certaines conditions de fond du mariage civil, et a convenu le mercredi 15 juin 2005, d’en faire rapport avec les amendements suivants : |

| That Bill C-38, in the Preamble, be amended by adding after line 11 on page 2 the following: | Que le projet de loi C-38, au préambule, soit modifié par adjonction, après la ligne 14, page 2, de ce qui suit : |
“WHEREAS it is not against the public interest to hold and publicly express diverse views on marriage;” | « qu'il n'est pas contraire à l'intérêt public d'avoir des opinions variées sur le mariage et de les exprimer publiquement; » |

| That Bill C-38, be amended by adding after line 42 on page 2, the following new clause: | Que le projet de loi C-38, soit modifié par adjonction, après la ligne 43, page 2, du nouvel article suivant : |
“3.1 For greater certainty, no person or organization shall be deprived of any benefit, or be subject to any obligation or sanction, under any law of the Parliament of Canada solely by reason of their exercise, in respect of marriage between persons of the same sex, of the freedom of conscience and religion guaranteed under the Canadian Charter of Rights and Freedoms or the expression of their beliefs in respect of marriage as the union of a man and woman to the exclusion of all others based on that guaranteed freedom.” | « 3.1 Il est entendu que nul ne peut être privé des avantages qu'offrent les lois fédérales ni se voir imposer des obligations ou des sanctions au titre de ces lois pour la seule raison qu'il exerce, à l'égard du mariage entre personnes de même sexe, la liberté de conscience et de religion garantie par la Charte canadienne des droits et libertés, ou qu'il exprime, sur la base de cette liberté, ses convictions à l'égard du mariage comme étant l'union entre un homme et une femme à l'exclusion de toute autre personne. » |
