The Standing Committee on Procedure and House Affairs met at 3:37 p.m. this day, in Room 112-N Centre Block, the Chair, Peter Adams, presiding.

 

Members of the Committee present: Peter Adams, Marlene Catterall, Rodger Cuzner, Yvon Godin, Michel Guimond, Joe Jordan, Gerald Keddy, Judi Longfield, Lynn Myers, Carolyn Parrish, Geoff Regan and Jacques Saada.

 

Acting Members present: Gilbert Barrette for Marlene Catterall, Aileen Carroll for Carolyn Parrish, Jean-Yves Roy for Michel Guimond and Ted White for Dale Johnston.

 

In attendance: Library of Parliament: James Robertson, Principal. House of Commons: Jean-Michel Roy, Legislative Clerk; Susan Baldwin, Legislative Clerk.

 

Appearing: Hon. Don Boudria, Minister of State and Leader of the Government in the House of Commons.

Pursuant to the Order of Reference of Tuesday, September 23, 2003, the Committee resumed consideration of Bill C-49, An Act respecting the effective date of the representation order of 2003.
 

The Committee resumed consideration of the amendment of Yvon Godin, — That Bill C-49, in Clause 1, be amended by replacing line 9 on page 1 with the following:

“mation is effective, for each province other than the Province of New Brunswick, on the first dissolution of”

The debate continued.

 

At 4:04 p.m., the sitting was suspended.

At 4:55 p.m., the sitting resumed.

 

The Committee resumed consideration of the amendment of Yvon Godin, — That Bill C-49, in Clause 1, be amended by replacing line 9 on page 1 with the following:

“mation is effective, for each province other than the Province of New Brunswick, on the first dissolution of”

The debate continued.

 

The question was put on the amendment of Yvon Godin and it was negatived on division.

 

Gerald Keddy moved, — That Bill C-49, in Clause 1, be amended by replacing line 9 on page 1 with the following:

“mation is effective on January 1, 2004 and shall be used on the first dissolution of”

Debate arose thereon.

 

The question was put on the amendment of Gerald Keddy and it was negatived on division.

 

Gerald Keddy moved, — That Bill C-49, in Clause 1, be amended by replacing lines 9 and 10 on page 1 with the following:

“mation is effective on April 1,”

Debate arose thereon.

 

The question was put on the amendment of Gerald Keddy and it was negatived on division.

 

Michel Guimond moved, — That Bill C-49, in Clause 1, be amended by replacing lines 9 to 11 on page 1 with the following:

“mation

( a ) in respect of each province other than the Province of Quebec, is effective on the first dissolution of Parliament that occurs on or after April 1, 2004; and

( b ) in respect of the Province of Quebec, has no force or effect.”

Debate arose thereon.

 

The question was put on the amendment of Michel Guimond and it was negatived on division.

 

Michel Guimond moved, — That Bill C-49, in Clause 1, be amended by replacing line 10 on page 1 with the following:

“Parliament that occurs on or after September 1,”

Debate arose thereon.

 

The question was put on the amendment of Michel Guimond and it was negatived on division.

 

Clause 1 carried on the following recorded division: YEAS: Aileen Carroll, Marlene Catterall, Rodger Cuzner, Joe Jordan, Judi Longfield, Lynn Myers, Geoff Regan, Jacques Saada, Ted White — 9; NAYS: Yvon Godin, Michel Guimond, Gerald Keddy, Jean-Yves Roy — 4.

 

By unanimous consent, Ted White moved, — That Bill C-49 be amended by adding after line 11 on page 1 the following:

“ 2. On the later of the coming into force of this Act and section 23 of An Act to amend the Canada Elections Act and the Income Tax Act (political financing), being Chapter 19 of the Statutes of Canada, 2003, subsection 25(2) of the Electoral Boundaries Readjustment Act is replaced by the following:

(2) For the purpose of authorizing and enabling, whenever required, the appointment of returning officers under section 24 of the Canada Elections Act or the registration of electoral district associations under subsection 403.22(4) of that Act, the representation order is deemed to be effective on the day on which the proclamation was issued.

3. In the case of any proclamation issued in 2003 under subsection 25(1) of the Electoral Boundaries Readjustment Act, the order referred to in that proclamation is deemed, for the purposes of subsection 25(2) of that Act, as enacted by section 2 of this Act, to be effective on January 1, 2004.”

After debate, the question was put on the amendment of Ted White and it was agreed to on division.

It was agreed on division, — That the Chair report Bill C-49, as amended, to the House.

 

It was agreed, — That Bill C-49, as amended, be reprinted for the use of the House at report stage.

 

At 5:51 p.m., the Committee adjourned to the call of the Chair.
