In accordance with its Order of Reference of Tuesday, February 25, 2003, your Committee has considered Bill C-19, An Act to provide for real property taxation powers of first nations, to create a First Nations Tax Commission, First Nations Financial Management Board, First Nations Finance Authority and First Nations Statistical Institute and to make consequential amendments to other Acts, and agreed on September 22, 2003, to report it with the following amendments:

Conformément à son Ordre de renvoi du mardi 25 février 2003, votre Comité a étudié le projet de loi C-19, Loi prévoyant les pouvoirs en matière d'imposition foncière des premières nations, constituant la Commission de la fiscalité des premières nations, le Conseil de gestion financière des premières nations, l'Administration financière des premières nations ainsi que l'Institut de la statistique des premières nations et apportant des modifications corrélatives à certaines lois, et a convenu le 22 septembre 2003, d’en faire rapport avec les amendements suivants :

New Clause 2.1

That Bill C-19 be amended by adding after line 4 on page 4 the following new clause:

“2.1 For greater certainty, nothing in this Act shall be construed so as to abrogate or derogate from any existing aboriginal or treaty rights of the aboriginal peoples of Canada under section 35 of the Constitution Act, 1982 .”
