Meeting No. 8

Thursday, March 29, 2001

The Standing Committee on Transport and Government Operations met at 11:00 a.m. this day, in Room 536, Wellington Building, the Chair, Ovid Jackson, presiding.

Member(s) of the Committee present: Larry Bagnell, Andy Burton, Bev Desjarlais, Brian Fitzpatrick, Jay Hill, Ovid Jackson, Mario Laframboise, Dominic LeBlanc, Marcel Proulx, Brent St. Denis, Paul Szabo.

Acting Member(s) present: André Harvey for Serge Marcil; Carmen Provenzano for Tony Tirabassi; Rodger Cuzner for Alex Shepherd; John Richardson for Tony Tirabassi.

In attendance: From the Library of Parliament: John Christopher; June Dewetering, researchers. From Legislative Services: Marc Toupin, Legislative Clerk.

Witness(es): From the B.F. Lorenzetti & Associates (Ontario) Inc.: Addy Buna. From the UFANS Insurance Services: Cedric Miller, Insurance wholesaler.

Pursuant to its Order of Reference of Friday, February 23, 2001, the Committee resumed consideration of Bill S-2, An Act respecting marine liability, and to validate certain by-laws and regulations (See Minutes of Proceedings, Tuesday, March 20, 2001, Meeting No. 5).

Each witness made a brief presentation and answered questions.

At 11:38 A.M. Carmen Provenzano arrived as a replacement for Tony Tirabassi.

At 11:54 A.M. the meeting was suspended.

At 11:57 A.M. the meeting was resumed. The Committee then proceeded to a clause by clause consideration of Bill S-2, An Act respecting Marine Liability, and to validate certain by-laws and regulations.

Clause 1 was postponed, pursuant to Standing Order 75(1).

By unanimous consent, Clauses 2 to 38 carried.

Jay Hill moved, - That Bill S-2, in Clause 39, be amended by replacing lines 35 to 38 on page 14 with the following:

"39. The Governor in Council shall make regulations by January 1, 2002 requiring insurance or evidence of financial security be maintained to cover liability under this Part."

And debate thereon, the question being put on the amendment, it was negatived on the following division:

Jay Hill moved, - That Bill S-2, in Clause 51, be amended by replacing line 3 on page 22 with the following:

"(a) for pollution damage from the ship;"

Jay Hill moved, - That Bill S-2, in Clause 51, be amended by replacing lines 14 to 16 on page 22 with the following:

"repair, remedy or minimize pollution damage from the ship, including measures taken in anticipation of a discharge of pollutants"

Jay Hill moved, - That Bill S-2, in Clause 51, be amended by replacing line 38 on page 22 with the following:

"(2) If pollution damage from a ship"

Jay Hill moved, - That Bill S-2, in clause 51, be amended by replacing, in the English version, lines 26 to 28 on page 23 with the following:

"repair, remedy or minimize pollution damage from the ship including measures taken in anticipation of a discharge of pollutants from"

And debate thereon.

Bev Desjarlais moved, - That the meeting be adjourned and the question being put on the motion, it was negatived on division.

The Committee resumed its consideration of Mr. Hill’s motions and the question being put the amendments, then were negatived by the following division:

By unanimous consent, Clauses 52 to 131 carried.

By unanimous consent, Schedules 1 to 4 carried.

Clause 1 carried.

Title carried.

Bill carried.

Ordered, - That the Chairman report Bill S-2 without amendments to the House.

At 1:15 p.m., the Committee adjourned to the call of the Chair.
