GOVERNMENT RESPONSE TO THE THIRD REPORT OF THE STANDING COMMITTEE ON PUBLIC ACCOUNTS

Chapter 3, Inuvialuit Final Agreement of the October 2007 Report of the Auditor General of Canada

ACTION PLAN AND STATUS REPORT

RECOMMENDATION 1

Indian and Northern Affairs Canada provide an Action Plan to the Public Accounts Committee as per the commitment made to the Committee on June 30, 2008, that describes how the Department will implement the recommendations made in Chapter 3: Inuvialuit Final Agreement of the Auditor General’s October 2007 Report.

A revised Action Plan which sets out the actions required to fulfill each recommendation was forwarded to the Committee in August 2008.

RECOMMENDATION 2

Indian and Northern Affairs Canada provide the Public Accounts Committee with a status report on its implementation of the recommendations contained in Chapter 3: Inuvialuit Final Agreement of the Auditor General’s October 2007 Report by 31 March 2009.

Indian and Northern Affairs Canada tracks its progress on management responses and action plans developed in regard to the Auditor General recommendations on a semi-annual basis. In addition the department provides, at mid-year and year-end, to the Auditor General status updates on progress on all recommendations. You will find attached the most recent update as of September 30, 2009 that was approved at INAC Audit Committee in December 2009.

LAND TRANSFERS

RECOMMENDATION 3

Indian and Northern Affairs Canada provide confirmation to the Public Accounts Committee that the transfer of land for the airport runway has occurred when final approval has taken place and that all of the parties involved in the transfer are content with the arrangements

The B&C Airports Agreement was signed by all the parties in October 2009. Canada, as represented by Transport Canada and Indian and Northern Affairs Canada, and the Inuvialuit reached agreement to acquire the three airport properties located in Sachs Harbour, Holman (Ulukhaktok) and Paulatuk. The survey of the three airport properties has been completed and the parties are actively engaged in completing the terms and conditions of the Agreement. Completion of the agreement is expected in early 2010.

The Pingo Canadian Landmark Land Exchange was finalized in July 2009 and the survey work required to complete the agreement was finished in late summer 2009. This transfer of lands fulfils Canada’s long outstanding obligation set out in the IFA regarding the exchange of land for the Pingo Canadian Landmark.

RECOMMENDATION 4

Indian and Northern Affairs Canada accelerate the development of guidelines to transfer lands to the Inuvialuit to 31 December 2008 and provide the Public Accounts Committee with a copy of the guidelines by that date.

Guidelines to transfer lands have been refined and formalized and are now in full use by the Parties. As of July 1, 2009, six sites have been vacated, cleaned up and returned to the Inuvialuit. There are several more sites, used by the Canadian Coast Guard, which are in the process of being released and returned to the Inuvialuit. Of the remaining 15 sites, 8 continue to be actively used by the original reserve holder and 7 are in various stages of being vacated, remediated and released to the Inuvialuit. INAC and the Inuvialuit Land Administration continue to work closely together toward administering the processing of the 15 remaining sites.

CONTRACTING OBLIGATIONS

RECOMMENDATION 5

Indian and Northern Affairs Canada provide the Public Accounts Committee with a copy of the updated Treasury Board Contracting Policy and that INAC provide an explanation of how the updated policy reflects the obligations stated in the Inuvialuit Final Agreement in its annual report on this Agreement.

Further to Recommendation 5, Indian and Northern Affairs Canada will work with the Inuvialuit to develop an explanation of how the updated policy reflects the obligations stated in the Inuvialuit Final Agreement for inclusion in the Inuvialuit Final Agreement Annual Report of 2008 – 2009.

Collection of information for the 2008-2009 Annual Report is underway. All parties have agreed to use a new results-based reporting format for this annual report. Completion of the report is expected for Spring 2010.

RECOMMENDATION 6

Indian and Northern Affairs Canada work with its partners in the Inuvialuit Final Agreement to clearly define “reasonable share” by 31 December 2008, and provide a copy of this definition to the Public Accounts Committee.

The resolution of the issue of “reasonable share” has been identified as a standing item at the Inuvialuit Final Agreement Implementation Committee meeting. The implementing parties of the Inuvialuit Implementation Committee have mutually agreed to a one year hiatus on discussions of “reasonable share”. The Committee has agreed to use the next year (until July 2010) to obtain and examine quarterly federal contracting data from Canada beginning in August 2009, in order to establish a better understanding of contracting in the settlement region. Where there are issues emerging in the examination of the quarterly contracting data, the Inuvialuit Regional Corporation will discuss with Canada ways in which they can work with federal departments in an attempt to revolve the matter. Where information gaps are identified, Canada and the Inuvialuit Regional Corporation will work together to address the issue and seek a solution as required. A regular agenda item will be added to the Implementation Committee agenda for the tabling and discussion of contracting data in the settlement region as it becomes available. The eventual definition is intended to be incorporated into learning material and guidance documents discussed above.

RECOMMENDATION 7

Indian and Northern Affairs Canada ensure that the untendered contracts awarded under the “reasonable share” provision of the Inuvialuit Final Agreement be priced in a similar manner to other untendered contracts by including this in the definition of “reasonable share”.

Indian and Northern Affairs Canada will take this recommendation into consideration, and examine its viability. Indian and Northern Affairs Canada will be working with affected departments and agencies as well as the Inuvialuit to develop a definition of "reasonable share" and endeavour to include this recommendation in those discussions.

ECONOMIC MEASURES REVIEW

RECOMMENDATION 8

Indian and Northern Affairs Canada include in its annual reports on the Inuvialuit Final Agreement a status report on the progress of the economic assessment and, once the assessment has been completed, status reports on the response to issues raised in the assessment.>

The Economic Measures Working Group, established in 2007, hired a contractor to visit the six major communities in the Inuvialuit Settlement Region in 2009 with a mandate to identify and develop one viable, community-driven project in each of the six communities. The process involved extensive community consultation and participation. The contractor produced a project "short list" for each community. This list has been reviewed by each community; housing rental projects being a prominent candidate in several communities. Preliminary networks are being formed between potential investors, partners and lending institutions to develop the shortlist projects.

At the IFA Implementation Coordination Committee meeting on October 8, 2009, the Inuvialuit Regional Corporation expressed appreciation for the work that Canada has put into this particular project and reiterated that "there is a real feeling that something new is being tried here". A meeting of the Working Group will be called in November to review the steps being taken on each of the shortlisted projects. It is anticipated that some of the shortlisted projects will move ahead by Spring 2010.

MONITORING ACHIEVEMENT OF PRINCIPLES

RECOMMENDATION 9

Indian and Northern Affairs Canada report on the progress made in achieving the Inuvialuit Final Agreement’s principles in its annual report on this Agreement.

It is anticipated that findings from the recently completed Impact Evaluation of Comprehensive Land Claims, in which the Inuvialuit participated, will provide baseline data that can be used to monitor future progress. The evaluation addressed six broad issue areas corresponding to anticipated outcomes of the agreements: fulfillment of Comprehensive Land Claims Agreement terms; clarity and certainty; enhancement of working relationships; stable and predictable environment for economic development; meaningful and effective voice for Aboriginal people in decision- making; and community social and cultural well-being.

INAC has provided the Inuvialuit Regional Corporation with a copy of the evaluation and requested that they select those indicators that appear to best address the areas of implementation relevant to the IFA, in order that they may be developed on a priority basis.

In addition, discussions have taken place with the IFA Implementation Committee to revise future annual reports to contain results-based information. This new format for the 2008-2009 annual report is expected to be completed by April 2010.

ACCOUNTABLITY

RECOMMENDATION 10

Indian and Northern Affairs publish its own annual report in a timely manner detailing its progress in the implementation of the Inuvialuit Final Agreement even if it does not have information from the other organisations involved in the Agreement. This annual report should also document which partner organisations have not provided information in time to be included in the report.

The 2007-2008 IFA annual report has been completed and translated and it is anticipated that it will be published early in 2010. Tabling of the Annual Report in Parliament will follow. Discussions have taken place with the Inuvialuit Final Agreement Implementation Committee members for more results based information in future reports. Work has accelerated on the reports in response to the Committee’s recommendations.

RECOMMENDATION 11

Indian and Northern Affairs Canada include a link in its Departmental Performance Report to an online report that includes details of its own results-based performance in the implementation of comprehensive land claims agreements.

INAC is currently in the process of developing a more robust monitoring and reporting system pertaining to the implementation of agreements and the status of the obligations. In order to be more transparent the system will support reporting against key implementation performance indicators noted in INAC’s Departmental Performance Report.

3.30 Recommendation. Indian and Northern Affairs Canada should develop and implement clear processes for

- ensuring the timely exchange of lands under the Inuvialuit Final Agreement, and

- cleaning up and returning control of parcels of land identified in Annex R that are no longer required by the federal government.

Annex R - As of July 1st, 2009, six sites have been vacated, cleaned up and returned to the Inuvialuit.  There are several more sites, mostly used by the Coast Guard, which have been vacated and are being inspected with the intention of returning them to the Inuvialuit. The remaining sites either, continue to be actively used by the original reserve holder or are in the process of being vacated and turned over to the Inuvialuit. INAC and the Inuvialuit Land Administration continue to work closely together towards the release of the remaining sites. 

The Pingo Canadian Landmark Land Exchange has been finalized and the survey work required to complete the agreement was finished in late summer 2009.  This transfer of lands fulfils Canada’s long outstanding obligation set out in the IFA regarding the exchange of land for the Pingo Canadian Landmark.

The B&C Airports Agreement has recently been approved by the Deputy Minister of Transport Canada.  This fulfills an outstanding obligation to exchange a parcel of land near the Inuvik Airport for the B&C Airports.

3.45 Recommendation. Indian and Northern Affairs Canada should clearly communicate to federal organizations the Government of Canada's contracting obligations in relation to the Inuvialuit Final Agreement. In addition, INAC should define the Agreement's term "reasonable share." It should also provide guidance to federal organizations as to how to fulfill their contract obligations to award to the Inuvialuit a reasonable share of non-competitively tendered contracts that are related to the Region.

 

3.45 Recommandation. Affaires indiennes et du Nord Canada devrait communiquer clairement aux organisations fédérales les obligations en matière de contrats du gouvernement du Canada aux termes de la Convention définitive des Inuvialuit. Le Ministère devrait aussi définir l'expression « part raisonnable » énoncée dans la Convention. Il devrait également donner aux organisations fédérales une orientation sur la façon de respecter leurs obligations à ce chapitre en attribuant aux Inuvialuit une part raisonnable des contrats accordés sans appel d'offres qui touchent la région désignée.

Since April 2009, INAC has held 30 information and learning sessions to provide guidance in the area of contracting and procurement as they relate to land claim agreements to approximately 540 federal employees across 20 federal departments. More sessions are scheduled to take place over the remaining 2 quarters.

3.46 Recommendation. In consultation with the Treasury Board Secretariat, Indian and Northern Affairs Canada, Public Works and Government Services Canada, the Parks Canada Agency, Fisheries and Oceans Canada, and Environment Canada should develop and/or enhance systems and procedures to enable them to monitor their compliance with the Inuvialuit Final Agreement's contracting provisions. To ensure compliance, these systems and procedures should monitor each federal organization's activities for

- notifying the Inuvialuit of contracts related to activities within the Region;

- awarding the Inuvialuit all contracts that are subject to public tender and related to activities within the Region, when the Inuvialuit submit the best bid;

- awarding the Inuvialuit a reasonable share of contracts that are not subject to public tender, that are related to activities within the Region, and for which the Inuvialuit are capable of supplying the required goods and services on a reasonable basis; and

- providing the Inuvialuit with contracts that relate to activities within the Region's national parks and landmark, on a preferred basis.

 

3.46 Recommandation. Affaires indiennes et du Nord Canada, Travaux publics et Services gouvernementaux Canada, l'Agence Parcs Canada, Pêches et Océans Canada et Environnement Canada devraient, de concert avec le Secrétariat du Conseil du Trésor, mettre au point des systèmes et des méthodes leur permettant d'établir s'ils respectent les dispositions de la Convention définitive des Inuvialuit relativement aux contrats, ou améliorer les méthodes et systèmes existants. Pour assurer le respect de ces dispositions, les systèmes et méthodes devraient permettre de surveiller les activités suivantes de chaque organisation fédérale :

- l'envoi aux Inuvialuit d'avis sur les contrats relatifs aux activités dans la région désignée;

Treasury Board Secretariat released Contracting Policy Notice 2008-4 - Amendments to the Treasury Board Contracting Policy: Clarification of the obligations to monitor and report contracts under Comprehensive Land Claim Agreements (CLCAs) on June 19, 2008.  Implementation of these changes takes effect April 2009 and names INAC’s Deputy Minister with specific responsibilities for the holding and reporting of data from federal departments’ contracting activities in CLCA areas. In addition, the Guideline (referred to in 3.45) will be provided to all federal departments to support their efforts in carrying out federal procurement in CLCA areas highlighting all the contracting provisions of the IFA.

3.53 Recommendation. Indian and Northern Affairs Canada should meet its responsibilities related to the economic review by

- assessing reasons for lack of progress identified in the first review;

- taking actions to respond to the first review; and

- leading the completion of a joint economic measures review every five years, until such time as the economic objectives have been met, as required in the Inuvialuit Final Agreement.

 

3.53 Recommandation. Affaires indiennes et du Nord Canada devrait s'acquitter de ses responsabilités en ce qui concerne l'examen économique. À cette fin, le Ministère devrait :

- évaluer les raisons de l'absence de progrès constatée lors du premier examen;

- prendre des mesures pour donner suite à cet examen;

3.76 Recommendation. Indian and Northern Affairs Canada should develop a strategic approach towards implementing Canada's obligations under the Inuvialuit Final Agreement. Such an approach should, at a minimum

- identify each of Canada's obligations and the appropriate federal organizations to address them, and should clearly communicate their obligations to these federal organizations;

- develop a plan to implement federal obligations; and

- regularly monitor and report to other signatories Canada's fulfillment of its obligations.

 

3.76 Recommandation. Affaires indiennes et du Nord Canada devrait élaborer une approche stratégique en vue d'assurer l'exécution des obligations du Canada aux termes de la Convention définitive des Inuvialuit. Dans le cadre de cette approche, le Ministère devrait à tout le moins :

- recenser chacune des obligations du Canada et déterminer les organisations fédérales qui en sont responsables, et informer clairement ces organisations de leurs responsabilités respectives;

- élaborer un plan d'exécution des obligations fédérales;

- assurer un suivi régulier du respect des obligations du Canada et en rendre compte aux autres signataires.

The IFA was signed in 1984. The requirement for an implementation plan to accompany all agreements was introduced in 1986 under the Comprehensive Claims Policy. The IFA consequently had no formal implementation plan. In spite of this, the department has identified that the IFA contains approximately 90 obligations, 15 of which are one-time activities. Of those 15, two have not been completed. These involve land exchange obligations and significant progress with parties to resolve the issues has been made, as noted above in 3.30. 

The 2007-2008 IFA annual report has been completed and translated. It should be published by December 2009. Discussions have taken place with Inuvialuit Final Agreement Implementation Committee members to revise future annual reports, containing more results based information. Parties are aiming to have this new format for the 2008-2009 annual report which is expected to be completed by January 2010.

INAC is also developing a 4-page annual reporting document which would highlight current activities and challenges in implementing Comprehensive Land Claim Agreements with the intent of making the document available to the public.

Furthermore, INAC is currently in the process of developing a more robust monitoring and reporting system pertaining to the implementation of agreements and more notably, the status of the obligations. The enhanced monitoring and reporting system will be fully populated by the winter of 2009-2010.  The system will support reporting against key implementation performance indicators noted in INAC’s Departmental Performance Report. This provides for enhanced transparency and accountability as to the implementation of federal responsibilities.

3.85 Recommendation. In cooperation with the Inuvialuit, and with the Yukon and Northwest Territories governments, Indian and Northern Affairs Canada should develop performance indicators to measure progress towards meeting the principles of the Inuvialuit Final Agreement, and should publicly monitor and report progress to other signatories.

INAC has provided the Inuvialuit Regional Corporation with a copy of the Impact Evaluation of Comprehensive Land Claim Agreements and requested the Inuvialuit Regional Corporation to select those indicators that appeared to best address the areas of implementation relevant to the IFA.  In addition, discussions have taken place with the IFA ICC to revise future annual reports to contain results-based information. This new format for the 2008-2009 annual report is expected to be completed by April 2010.
