The Order was read for the second reading and reference to the Standing Committee on Environment and Sustainable Development of Bill C-34, An Act to amend the Migratory Birds Convention Act, 1994 and the Canadian Environmental Protection Act, 1999.

Pursuant to Standing Order 73(1), Mr. Anderson (Minister of the Environment) , seconded by Mr. Bélanger (Deputy Leader of the Government in the House of Commons) , moved, — That the Bill be referred forthwith to the Standing Committee on Environment and Sustainable Development.

Vacancies

The Speaker informed the House that a vacancy had occurred in the representation in the House of Commons, for the Electoral District of Charleswood St. James—Assiniboia, in the Province of Manitoba, by reason of the resignation of Mr. John Harvard, and that, pursuant to paragraph 25(1)(b) of the Parliament of Canada Act, he had addressed, on Thursday, May 6, 2004, his warrant to the Chief Electoral Officer for the issue of a writ for the election of a member to fill the vacancy.

Introduction of Government Bills

Pursuant to Standing Orders 68(2) and 69(1), on motion of Mr. Cotler (Minister of Justice) , seconded by Mr. Bélanger (Deputy Leader of the Government in the House of Commons) , Bill C-35, An Act to amend the Criminal Code, the DNA Identification Act and the National Defence Act, was introduced, read the first time, ordered to be printed and ordered for a second reading at the next sitting of the House.

Presenting Reports from Inter-parliamentary Delegations

Pursuant to Standing Order 34(1), Mr. Lincoln (Lac-Saint-Louis) presented the Report of the Canadian delegation of the Canada-Europe Parliamentary Association (OSCE) to the Third Winter Session of the Organization for Security and Cooperation in Europe Parliamentary Assembly (OSCE PA), held in Vienna, Austria, on February 19 and 20, 2004. — Sessional Paper No. 8565-373-61-02.

Presenting Reports from Committees

Mr. Proulx (Hull—Aylmer) , from the Standing Committee on Procedure and House Affairs, presented the 28th Report of the Committee, which was as follows:

Mr. Boudria (Glengarry—Prescott—Russell) , from the Standing Committee on Official Languages, presented the Third Report of the Committee, “Impact of the Plan to Strengthen Management of Government of Canada Advertising on the Official-Language Minority Media”. — Sessional Paper No. 8510-373-46.

Pursuant to Standing Order 109, the Committee requested that the government table a comprehensive response.

First Reading of Senate Public Bills

The House resumed consideration of the motion of Mr. Mitchell (Minister of Indian Affairs and Northern Development) , seconded by Mr. Owen (Minister of Public Works and Government Services) , — That Bill C-23, An Act to provide for real property taxation powers of first nations, to create a First Nations Tax Commission, First Nations Financial Management Board, First Nations Finance Authority and First Nations Statistical Institute and to make consequential amendments to other Acts, be now read a third time and do pass;

And of the amendment of Mr. Loubier (Saint-Hyacinthe—Bagot) , seconded by Mr. Cardin (Sherbrooke) , — That the motion be amended by deleting all the words after the word “That” and substituting the following:

“Bill C-23, an act to provide for real property taxation powers of first nations, to create a First Nations Tax Commission, First Nations Financial Management Board, First Nations Finance Authority and First Nations Statistical Institute and to make consequential amendments to other Acts, be not now read a third time because it fails to meet the needs of most First Nations.”.
