Question of Privilege

A question of privilege having been raised by Mr. Breitkreuz (Yorkton—Melville) in relation to the immunity of Members of the House from being compelled to attend court during, immediately before and immediately after a session of Parliament, the Speaker ruled that there was a prima facie case of privilege;

Whereupon, Mr. Breitkreuz (Yorkton—Melville) , seconded by Mr. Epp (Elk Island) , moved, — That the matter of the question of privilege raised on May 12 and 16, 2003 and February 5, 2004 be referred to the Standing Committee on Procedure and House Affairs.

The question was put on the motion and it was agreed to.

Government Orders

Mr. Saada (Leader of the Government in the House of Commons) , seconded by Mr. Mitchell (Minister of Indian Affairs and Northern Development) , moved, — That during the first thirty sitting days of the present session of Parliament, whenever a Minister of the Crown, when proposing a motion for first reading of a public bill, states that the said bill is in the same form as a Government bill in the previous session, if the Speaker is satisfied that the said bill is in the same form as the House of Commons had agreed to at prorogation, notwithstanding Standing Order 71, the said bill shall be deemed in the current session to have been considered and approved at all stages completed at the time of prorogation of the previous session. (Government Business No. 2)

Mr. Breitkreuz (Yorkton—Melville) , seconded by Mr. Penson (Peace River) , moved the following amendment, — That the motion be amended by adding the following:

“excluding the following Bills:

C-7, An Act respecting leadership selection, administration and accountability of Indian bands, and to make related amendments to other Acts;

C-13, An Act respecting assisted human reproduction;

C-19, An Act to provide for real property taxation powers of first nations, to create a First Nations Tax Commission, First Nations Financial Management Board, First Nations Finance Authority and First Nations Statistical Institute and to make consequential amendments to other Acts;

Mr. Merrifield (Yellowhead) , seconded by Mr. Fitzpatrick (Prince Albert) , moved the following subamendment, — That the amendment be amended by adding after the words “Substances Act” the following:

“C-49, An Act respecting the effective date of the representation order of 2003”.

Private Members' Business

At 1:30 p.m., pursuant to Standing Order 30(6), the House proceeded to the consideration of Private Members' Business.

The Order was read for the second reading and reference to the Standing Committee on Health of Bill C-398, An Act to amend the Food and Drugs Act (food labelling).

Mr. Wappel (Scarborough Southwest) , seconded by Mr. Hubbard (Miramichi) , moved, — That the Bill be now read a second time and referred to the Standing Committee on Health.

Pursuant to Standing Order 93, the Order was dropped to the bottom of the order of precedence on the Order Paper.
