Pursuant to the order of reference of Tuesday, February 16, 2021, the committee resumed consideration of Bill C-10, An Act to amend the Broadcasting Act and to make related and consequential amendments to other Acts.

Thomas Owen Ripley answered questions.

The committee resumed its clause-by-clause study of the Bill.

The Committee resumed clause-by-clause consideration on Clause 7 of the Bill, as amended.

The Committee resumed consideration of the amendment of Julie Dabrusin, — That Bill C-10, in Clause 7, be amended

(a) by adding after line 31 on page 7 the following:

“(i.1) in relation to online undertakings that provide a social media service, the discoverability of Canadian creators of programs”; and

(b) by adding after line 10 on page 8 the following:

“(3.1) Orders made under this section, other than orders made under paragraph (1)(e.2), (i.1) or (j), do not apply in respect of programs that are uploaded to an online undertaking that provides a social media service by a user of the service — if that user is not the provider of the service or the provider’s affiliate, or the agent or mandatary of either of them — for transmission over the Internet and reception by other users of the service.”

Martin Champoux moved, — That the amendment, in paragraph (i.1), be amended by removing the words “creators of”.

After debate, the question was put on the subamendment of Martin Champoux and it was negatived on the following recorded division:

YEAS: Alexandre Boulerice, Martin Champoux — 2;

NAYS: Scott Aitchison, Julie Dabrusin, Andy Fillmore, Anthony Housefather, Marci Ien, Tim Louis, Alain Rayes, Martin Shields, Kevin Waugh — 9.

Martin Champoux moved, — That paragraph (b) of Motion No. G-11.1, proposing to amend Clause 7 of Bill C-10 by adding text after line 10 on page 8, be amended by adding the following at the end of the proposed text:

(3.2) For greater certainty, paragraph (1)(i.1) shall be construed and applied in a manner that is consistent with the freedom of expression enjoyed by users of social media services provided by online undertakings.

After debate, the question was put on the subamendment of Martin Champoux and it was agreed to.

The question was put on the amendment of Julie Dabrusin, as amended, and it was agreed to on the following recorded division:
