Pursuant to the order of reference of Tuesday, February 16, 2021, the committee resumed consideration of Bill C-10, An Act to amend the Broadcasting Act and to make related and consequential amendments to other Acts.

Motion

Anthony Housefather moved, — That the Committee:

1) Ask the Minister of Justice to provide a revised Charter Statement on Bill C-10, as soon as possible, focusing on whether the committee’s changes to the Bill related to programs uploaded by users of social media services have impacted the initial Charter statement provided, in particular as relates to Section 2(b) of the Canadian Charter of Rights and Freedoms.

2) Invite the Minister of Justice and the Minister of Canadian Heritage accompanied by relevant department officials to appear before the committee as soon as possible to discuss the revised Charter statement and any implications of amendments made by the committee to the Bill.

At 11:11 a.m., the sitting was suspended.

At 11:25 a.m., the sitting resumed.

Amendment

Kevin Waugh moved, — That the motion be amended by replacing the word “programs” with the word “content”; by replacing the words “Justice and the Minister” with “Justice, the Minister”; by adding the words “, and Dr. Michael Geist” after the words “relevant department officials”; by adding the word “separately” after the words “to appear”; and by adding the following:

3) Will consider, notwithstanding any Standing Order or usual practice, additional amendments to the bill, including to clauses previously disposed of, arising from the evidence received through points 1 and 2 above, provided that the amendments are submitted no later than 7 days following the completion of both points 1 and 2.

Debate arose thereon.

RULING BY THE CHAIR

The Chair ruled the proposed amendment inadmissible as it sought to have the committee consider previously disposed of amendments to clauses of Bill C-10, An Act to amend the Broadcasting Act and to make related and consequential amendments to other Acts. A committee’s decision, once made, stands, as provided on page 1064 of House of Commons Procedure and Practice, Third Edition.

The Committee resumed consideration of the motion of Anthony Housefather, — That the committee:

3) Suspend clause-by-clause consideration of Bill C-10 until the completion of both points 1 and 2.

Debate arose thereon.

Subamendment

Alain Rayes moved, — That the amendment be amended by deleting the word “separately”.

The question was put on the subamendment of Alain Rayes and it was agreed to.

The Committee resumed consideration of the amendment of Kevin Waugh, as amended, — That the motion be amended by replacing the word “programs” with the word “content”; by replacing the words “Justice and the Minister” with “Justice, the Minister”; by adding the words “, and Dr. Michael Geist” after the words “relevant department officials”; and by adding the following:

3) Suspend clause-by-clause consideration of Bill C-10 until the completion of both points 1 and 2.

Subamendment

Anthony Housefather moved, — That the amendment be amended by replacing the words “, and Dr. Michael Geist" with the words ", and an expert panel consisting of one witness from each recognized party".
