The Chair called Clause 1.
On Clause 1,
Ron McKinnon moved, — That Bill C-375, in Clause 1, be amended by replacing lines 7 to 9 on page 1 with the following:“(a.1) any aspect of the offender’s mental condition that is relevant for sentencing purposes, as well as any mental health services or support available to the offender.”
Debate arose thereon.
The question was put on the amendment of Ron McKinnon and it was agreed to, by a show of hands: YEAS: 6; NAYS: 1.
“(2) Section 721 of the Act is amended by adding the following after subsection (3):
(3.1) Information on the matters referred to in paragraph (3)(a.1) shall be filed with the court in a separate document and the court shall examine the document to determine whether disclosure of any of the information contained in it would be contrary to the best interests of the offender.”
Debate arose thereon.
At 3:48 p.m., the sitting was suspended.
At 3:54, the sitting resumed.
Rob Nicholson moved, — That the amendment be amended by deleting all the words after the word “whether” and substituting the following:
“any of the information contained in it should not be disclosed, having regard to the offender's privacy interests.”
The question was put on the subamendment of Rob Nicholson and it was agreed to, by a show of hands: YEAS: 8; NAYS: 0.
Debate resumed on the amendment of Murray Rankin.
The question was put on the amendment of Murray Rankin, as amended, and it was negatived, by a show of hands: YEAS: 3; NAYS: 5.

The Bill, as amended, carried on division.
