It was agreed, — That the Committee, pursuant to Standing Order 97.1, recommend that the House of Commons do not proceed further with Bill C-247, An Act to amend the Criminal Code (passive detection device) because:

While the intent behind Bill C-247 is commendable, the Committee concluded, based on the evidence gathered during our study, that the costs of introducing such devices and the time and resources required for developing the appropriate testing mechanisms for them outweigh the potential benefits. The Committee also noted that passive detection devices have not yet been submitted for approval by the Alcohol Test Committee and that questions remain regarding their reliability, particularly in the Canadian climate.

Recognizing the need to improve detection of impairment while driving, either by drugs or alcohol, and to ensure a comprehensive solution to the problem, the Committee requests that the Government consider introducing legislation on this topic at the earliest opportunity; and

That the Chair present this report to the House.

The Committee resumed consideration of a draft report.

It was agreed, — That the draft report, as amended, be adopted.

It was agreed, — That the report be entitled: "The New Process for Judicial Appointments to the Supreme Court of Canada".

It was agreed, — That the Chair, Clerk and analyst be authorized to make such grammatical and editorial changes as may be necessary without changing the substance of the report.

It was agreed, — That, pursuant to Standing Order 109, the Committee request that the Government table a comprehensive response to the report.
