Pursuant to the Order of Reference of Wednesday, March 8, 2017, the Committee resumed consideration of Bill C-211, An Act respecting a federal framework on post-traumatic stress disorder.

The Committee commenced its clause-by-clause study of the Bill.

Pursuant to Standing Order 75(1), consideration of Clause 1, Short Title, and the Preamble were postponed.

The Chair called Clause 2.

By unanimous consent, it was agreed, — That Todd Doherty, M.P., be authorized to make a statement on the intent of Bill C-211, An Act respecting a federal framework on post-traumatic stress disorder.

Clause 2 carried by a show of hands: YEAS: 8; NAYS: 1.

On Clause 3,

John Oliver moved, — That Bill C-211, in Clause 3, be amended by

(a) replacing line 17 on page 2 with the following:

of Veterans Affairs, the Minister of Public Safety and Emergency Preparedness, provincial and territorial government

(b) replacing lines 21 to 24 on page 2 with the following:

After debate, the question was put on the amendment of John Oliver and it was agreed to, by a show of hands: YEAS: 8; NAYS: 1.

Clause 3, as amended, carried by a show of hands: YEAS: 8; NAYS: 1.

Clause 4 carried by a show of hands: YEAS: 8; NAYS: 0.

Clause 5 carried by a show of hands: YEAS: 6; NAYS: 0.

After debate, Clause 1, Short Title, carried by a show of hands: YEAS: 9; NAYS: 0.

On Preamble,

Don Davies moved, — That Bill C-211, in the preamble, be amended by replacing lines 8 to 11 on page 1 with the following:

“Whereas there is a clear need for all Canadians suffering from PTSD to receive direct and timely access to evidence-based”

Debate arose thereon.

RULING BY THE CHAIR

The Chair ruled the proposed amendment inadmissible because the amendment seeks to make a substantive modification by adding new elements to the preamble.

As House of Commons Procedure and Practice, second edition, states on page 770:

“In the case of a bill that has been referred to committee after second reading, a substantive amendment to the preamble is admissible only if it is rendered necessary by amendments made to the bill. In addition, an amendment to the preamble is in order when its purpose is to clarify it or to ensure uniformity of the English and French versions.”

In the opinion of the Chair, the proposed amendment is substantive and is therefore inadmissible.

Whereupon, Don Davies appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was sustained, by a show of hands: YEAS: 8; NAYS: 1.

Doug Eyolfson moved, — That Bill C-211, in the preamble, be amended by replacing line 21 on page 1 with the following:

“itary personnel, corrections officers, health care providers and members of”

RULING BY THE CHAIR

At 12:23 p.m., the sitting resumed in camera.

Pursuant to Standing Order 108(2) and the motion adopted by the Committee on Tuesday, April 4, 2017, the Committee resumed its study of the thalidomide survivors contribution program.

The Committee proceeded to give drafting instructions to the analysts for a report.

It was agreed, — That, in relation to the study of thalidomide survivors contribution program, the Committee’s findings be communicated in a letter addressed to the Minister of Health.

At 1:00 p.m., the Committee adjourned to the call of the Chair.
