Joe Comartin presented a motion which reads as follows:
Motion for Review of Security Certificates
Whereas it has been accepted by a majority of the subcommittee that its review of C-36 should include an examination of the use of Security Certificates issued pursuant to the Immigration and Refugee Protection Act;
Whereas the Minister of Justice has publicly indicated his support for a review of Security Certificates issued pursuant to the Immigration and Refugee Protection Act;
Whereas the Federal Court of Appeal, in the recent case, Hassan Almrei v. The Minister of Citizenship & Immigration and Solicitor General of Canada, has called for a review of the use of Security Certificates pursuant to the Immigration and Refugee Protection Act;
Whereas the recent House of Lords case in the United Kingdom, A (FC) and others (FC) (Appellants) v. Secretary of State for the Home Department (Respondent) and X (FC) and another (FC) (Appellants) v. Secretary of State for the Home Department(Respondent), struck down preventative detention sections of its own antiterrorism act;
Whereas the Minister of Justice has called upon the Subcommittee of the Standing Committee of Justice, Human Rights, Public Safety and Emergency Preparedness, also known as the Subcommittee on Public Safety and National Security to undertake a study of Section 4 of the Security and Information Act;
Whereas any review of C-36 without review of the use of Security Certificates would undermine the utility and value of the review of the legislation;
Therefore be it resolved that the Subcommittee on Public Safety and National Security as part of its review of C-36, the Anti-Terrorism Act be mandated to undertake a review of Section 4 of the Security and Information Act and a study of the use of Security Certificates, and report on each.
