| In accordance with its Order of Reference of Thursday, September 18, 2014, your Committee has considered Bill S-3, An Act to amend the Coastal Fisheries Protection Act, and agreed on Tuesday, April 28, 2015, to report it with the following amendments: | Conformément à son Ordre de renvoi du jeudi 18 septembre 2014, votre Comité a étudié le projet de loi S-3, Loi modifiant la Loi sur la protection des pêches côtières, et a convenu le mardi 28 avril 2015, d’en faire rapport avec les amendements suivants : |

| That Bill S-3, in Clause 4, be amended by adding after line 18 on page 4 the following: | Que le projet de loi S-3, à l’article 4, soit modifié par adjonction, après la ligne 18, page 4, de ce qui suit : |
“(3) No person shall import any fish or marine plant that is not accompanied by the documentation required by regulation.” | « (3) Nul ne peut importer du poisson ou une plante marine non accompagnés des documents réglementaires. » |

| That Bill S-3, in Clause 5, be amended by adding after line 45 on page 4 the following: | Que le projet de loi S-3, à l’article 5, soit modifié par adjonction, après la ligne 45, page 4, de ce qui suit : |
(2.1) Section 6 of the Act is amended by adding the following after paragraph (d): “(d.1) respecting documentation required for the importation of fish and marine plants;” | (2.1) L’article 6 de la même loi est modifié par adjonction, après l’alinéa d), de ce qui suit : « d.1) régir les documents requis pour l’importation de poissons et de plantes marines; » |

| That Bill S-3, in Clause 9, be amended by (a) replacing line 5 on page 13 with the following: | Que le projet de loi S-3, à l’article 9, soit modifié par substitution, aux lignes 4 à 8, page 13, de ce qui suit : |
“9.Paragraphs 14(a) to (c) of the Act are replaced” | «9. Les alinéas 14a) à c) de la même loi sont remplacés par ce qui suit : a) du bateau de pêche saisi aux termes de l’alinéa 9(1)a) ayant servi ou donné lieu à l’infraction ou, si le bateau a été vendu, du produit de la vente; b) des biens se trouvant à bord du bateau de pêche visé à l’alinéa a), y compris le poisson, les plantes marines, les agrès et apparaux, les garnitures, l’équipement, le matériel, les approvisionnements et la cargaison, ou du produit de la vente visée à l’article 11; b.1) des biens saisis en vertu de l’alinéa 9(1)b) se trouvant dans tout autre lieu, y compris le poisson, les plantes marines, les agrès et apparaux, les garnitures, l’équipement, le matériel, les approvisionnements et la cargaison et ayant servi ou donné lieu à l’infraction ou ayant été obtenus à la suite de la perpétration de celle-ci, ou du produit de la vente visée à l’article 11; c) de tout bateau de pêche visé à l’alinéa a) et de tout bien visé aux alinéas b) ou b.1), ou du produit de la vente de ceux-ci; » |

“(a) any fishing vessel seized under paragraph 9(1)(a) by means of or in relation to which the offence was committed, or, if the vessel has been sold, the proceeds of the sale, (b) any goods aboard a fishing vessel described in paragraph (a), including fish, marine plants, tackle, rigging, apparel, furniture, stores and cargo, or, if any of the goods have been sold under section 11, the proceeds of the sale, (b.1) any goods seized under paragraph 9(1)(b) in any other place, including fish, marine plants, tackle, rigging, apparel, furniture, stores and cargo, by means of or in relation to which the offence was committed, or that were obtained by or used in the commission of the offence, or, if any of the goods have been sold under section 11, the proceeds of the sale, or (c) any fishing vessel described in paragraph (a), or the proceeds of the sale of the vessel, and any of the goods described in paragraph (b) or (b.1), or the proceeds of the sale of the goods,” | |

| That Bill S-3, in Clause 16, be amended by adding after line 33 on page 18 the following: | Que le projet de loi S-3, à l’article 16, soit modifié par adjonction, après la ligne 31, page 18, de ce qui suit : |
“(3) Every person who contravenes subsection 5.6(3) is guilty of an offence and liable (a) on conviction on indictment, to a fine of not more than $500,000; or (b) on summary conviction, to a fine of not more than $100,000.” | « (3) Quiconque contrevient au paragraphe 5.6(3) commet une infraction et encourt, sur déclaration de culpabilité : a) par mise en accusation, une amende maximale de cinq cent mille dollars; b) par procédure sommaire, une amende maximale de cent mille dollars. » |
