The Standing Committee on Health has the honour to present its Le Comité permanent de la santé a l’honneur de présenter son
FOURTH REPORT QUATRIÈME RAPPORT
Pursuant to Standing Order 108(2), and a motion adopted by the Committee on Tuesday, April 15, 2008, your Committee recommends with respect to the New Organ Donor Regulations:

  • That the Minister of Health take action, at the earliest possible opportunity, to amend the new health regulations on organ donor criteria since the current wording specifically excludes gay men from being organ donors; and,


  • That the Minister also replace the current regulations with scientifically based guidelines to medical practitioners that protect the supply of organs, promote participation of donors and preserve the integrity of the organ supply.



Pursuant to Standing Order 109, the Committee requests that the government table a response to the recommendations outlined in this report.		 Conformément à l'article 108(2) du Règlement et la motion adoptée par le Comité le mardi 15 avril 2008, votre Comité recommande à l'égard de la nouvelle réglementation régissant les donneurs d'organes :

  • Que le ministre de la Santé agisse dès que possible pour modifier la nouvelle réglementation en matière de santé qui définit les critères régissant les donneurs d’organes, car dans son libellé actuel, elle empêche expressément les gais d’être donneurs; et,

  • Que le ministre remplace aussi la réglementation existante par des lignes directrices à l’intention des médecins praticiens qui sont fondées scientifiquement et qui protègent l’approvisionnement en organes, favorisent la participation des donneurs et assurent l’intégrité de l’approvisionnement.

Conformément à l'article 109 du Règlement, le Comité demande au gouvernement de déposer une réponse aux recommandations énumérées dans ce rapport.
