| In accordance with its mandate under Standing Order 108(2) and the motion adopted on October 14, 2004 by the Committee, its Subcommittee on Human Rights and International Development has considered the issue of Human Rights in Burma and recommends the following: | Conformément au mandat que lui confère le paragraphe 108(2) du Règlement et la motion adoptée le 14 octobre 2004 par le Comité, son Sous-comité des droits de la personne et du développment international a examiné la question des droits de la personne en Birmanie et recommande ce qui suit: |
| That the Committee is of the opinion that the government must: | Que le Comité est d’avis que le gouvernement doit: |
| a) condemn more forcefully the repeated and systematic human rights violations committed by the military junta in power in Burma, particularly those involving certain minority groups, including arrests and imprisonment without trial, summary and arbitrary executions, torture, rape, kidnappings of women, men and children, forced labour, denial of fundamental freedoms, including the freedom of assembly, association and expression, the recruitment of child soldiers and massive relocations of civilian populations; | a) condamner encore plus vigoureusement les violations systématiques et répétées des droits de la personne perpétrées par la junte militaire au pouvoir en Birmanie, particulièrement à l’égard de certaines minorités, exactions qui se traduisent, entre autres, par des arrestations et incarcérations sans procès, des exécutions sommaires et arbitraires, la torture, le viol, les enlèvements de femmes, d’hommes et d’enfants, le travail forcé, la négation des libertés fondamentales, notamment de réunion, d’association et d’expression, l’enrôlement forcé d’enfants soldats et les déportations massives de populations civiles; |
| b) urge the authorities in Burma to release immediately and unconditionally all political prisoners, in particular Nobel Laureate Aung San Suu Kyi, leader of the National League for Democracy (NLD), to end their harassment of them, to abolish all repressive laws and measures contravening international human rights conventions, and to take action to end the appalling humanitarian crisis facing hundreds of thousands of displaced people and refugees at Burma’s borders (with China, India, Bangladesh and Thailand); | b) exhorter les autorités de la Birmanie à libérer immédiatement et sans aucune condition tous les prisonniers politiques, en particulier la lauréate du Prix Nobel de la Paix et leader de la Ligue nationale pour la démocratie (LND), madame Aung San Suu Kyi, à cesser tout harcèlement à leur encontre, à abolir toutes les lois et mesures répressives contrevenant aux conventions internationales sur les droits de la personne, et à intervenir afin de mettre fin à la crise humanitaire dramatique à laquelle font face des centaines de milliers de personnes déplacées et de réfugiés aux frontières de la Birmanie (Chine, Inde, Bangladesh et Thaïlande); |
| c) provide tangible support to the legitimate authorities in Burma, specifically the government in exile (the National Coalition Government for the Union of Burma) and the Committee Representing the People’s Parliament; | c) démontrer concrètement son soutien aux autorités légitimes de la Birmanie, notamment au gouvernement en exil (National Coalition Government for the Union of Burma) et au Comité représentant le Parlement du Peuple; |
| d) impose more comprehensive economic measures on Burma, and in particular: | d) imposer davantage de mesures économiques à l’encontre de la Birmanie, et en particulier : |
| - review the effectiveness of the Export and Import Perrmits Act; | - revoir l’efficacité de la Loi sur les licences d’exportation et d’importation; |
| - review the feasibility of fully invoking the Special Economic Measure Act; and | - examiner la faisabilité d’invoquer pleinement la Loi sur les mesures économique spéciales; |
| - impose a legal ban on further investment in Burma | - imposer une interdiction d’investissement supplé-mentaire en Birmanie aux termes de la loi |
| e) bring pressure to bear on the United Nations Secretary General and the international community, in order to establish a framework, primarily though ensuring the spread of the embargo, to bring the military junta to negotiate a peaceful transition toward democracy, in cooperation with the NLD and representatives of ethnic minority groups, as set out in all the resolutions of the United Nations on Burma since 1994; | e) faire pression auprès du secrétaire général des Nations Unies et de la communauté internationale, afin d’établir un cadre de travail ayant pour objectif, notamment par la généralisation de l’embargo, d’amener enfin la junte militaire à négocier une transition pacifique vers la démocratie, et ce en collaboration avec la LND et les représentants des minorités ethniques, tel que promulgué, depuis 1994, dans toutes les résolutions des Nations Unies sur la Birmanie; |
| f) call upon the authorities in Burma to include the National League for Democracy (NLD) and other political parties in the on-going process of the National Convention, and warn that any outcome from the convention without the participation of the NLD and other parties will not be recognized. | f) appeler les autorités birmanes à inclure la Ligue nationale pour la démocratie (LND) et les autres partis politiques dans le processus actuel de convention nationale, et les avertir que toute conclusion de la convention obtenue sans la participation de LND ni des autres partis ne sera pas reconnu. |
